Pursuant to the California Public Records Act, I hereby request the following records:

Information on all hate crimes occuring in the city of jurisdiction from January 1, 2010 to December 31, 2020. The information should include (although not be restricted to) the following: date-of-occurrence (YYYY-MM-DD), time-of-occurrence (HH:MM), description of crime committed, location information at the finest geographic level available (street address or block), beat, district, weapon used, bias motivation (e.g., Anti-Black/Anti-Gay/Anti-Transgender), number of suspect(s), number of victim(s), injuries incurred, suspect(s) race, victim(s) race, victim(s) sex, suspect(s) sex,, victim(s) age, suspect(s) age.

Please provide me with these public records in a machine-readable ASCII format, such as a CSV, SQL, TXT, or similar raw file. CSV or SQL files are preferred when available. Please email the responsive records to my email address: michaeltopper@ucsb.edu.

If email transmission is not feasible, I agree to prepay the actual cost of the storage medium on which the responsive records are transmitted, any postage costs incurred.

We are continuing to review the responsive record, which will be redacted to protect from disclosure confidential information, pursuant to Government Code Sections 6254(f)(3), 6254(k), and 6255, the Penal Code, and the Welfare and Institutions Code Section 827.9.

 

Furthermore, regarding your request for the injuries incurred, please be advised that the Department does not track or maintain this data in a database. In order to collect the data, the Department would have to take affirmative steps to manually search each report to determine if any records contain the information you have requested. Thus, the Department asserts Government Code Section 6255 of the California Public Records Act, which exempts records where “the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure." The “public interest” provision of Section 6255 includes an exemption where production of the requested information would be unduly burdensome to the public agency involved. Therefore, we are denying this item of your request.

 

The Department estimates that it will provide you with the responsive, redacted record by or before January 2, 2023.

We have completed our review of your request to the Los Angeles Police Department (“LAPD” or “Department”) under the California Public Records Act (Cal. Govt. Code section 6250, et seq., hereinafter the “CPRA” or “Act”) seeking the following:

 

"Information on all hate crimes occuring in the city of jurisdiction from January 1, 2010 to December 31, 2020. The information should include (although not be restricted to) the following: date-of-occurrence (YYYY-MM-DD), time-of-occurrence (HH:MM), description of crime committed, location information at the finest geographic level available (street address or block), beat, district, weapon used, bias motivation (e.g., Anti-Black/Anti-Gay/Anti-Transgender), number of suspect(s), number of victim(s), injuries incurred, suspect(s) race, victim(s) race, victim(s) sex, suspect(s) sex, victim(s) age, suspect(s) age." [sic] 

 

The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 6254(b); 6254(c); 6254(f); 6254(k); and 6255.

 

A responsive document has been provided to you, pertaining to hate crime data from January 1, 2010 to December 31, 2020, including column fields for date and time of occurrence, report number ("DR_NBR"), area, reporting district, description of crime committed, bias motivation, weapon used, party (suspect, victim, arrestee, or involved party), party sequence (the ordinal number of suspect(s) and victim(s) for each incident), and the suspects' and victims' sex, descent (which includes race), and ages.

For the requested location information, you may cross-reference the provided report numbers ("DR_NBR") in Column D of the responsive document with the crime data publicly available on the City's Open Data portal. By doing so, this eliminates the need to review each individual incident location for confidentiality and privacy exemptions; therefore, no redactions were necessary.
