RE: PUBLIC RECORDS REQUEST of February 25, 2021, Reference # P000366-022521.
Dear MuckRock News,

The Livermore Police Department received the following request from you on February 25, 2021.

Your request is being processed in accordance with California Government Code Section 6250 and the California Public Records Act (CPRA). The CPRA requires public agencies make reasonably identified, non-exempt public records available for inspection or provide copies upon payment of the direct costs of duplication.
You requested the following:
Records sufficient to show the names, star numbers, respective dates, and type of time off of all police officers. See attached email.
Please provide the following clarification:
We are still reviewing and gathering records responsive to your request. Please note that personnel records for sworn officers are exempt from public disclosure pursuant to Penal Code section 832.7(a), and personnel records for all employees are exempt under Government Code section 6254(c). These records include specific information about what types of leave an employee may have requested (i.e. sick leave, workers compensation time, personal time etc.) Given these exemptions, do you still want information that shows which employees were on/off duty during those time periods?
If you would like for the Livermore Police Department to proceed with your public information request, please provide clarification within 30 days from 05/06/2021. Otherwise, the Livermore Police Department will consider your request withdrawn.
You may provide a response to the Livermore Police Department by any of the following methods:
1. Replying through the Records Request Portal
2. By facsimile to 925-371-4950
3. By mail to the Livermore Police Department, 1110 S. Livermore Ave, Livermore, CA 94550.
Upon receipt of your clarification, the Livermore Police Department will further respond to your request as required by law, including providing you with an estimate of costs associated with producing the requested records.
If you have any questions, please contact me at 925-371-4909.
Sincerely,
Jennifer Michelson

Dear Ms. Michelson,

Thank you for your response.

I would appreciate it if you could provide an itemized list about portions of my original request which are exempt from public disclosure according to Penal Code section 832.7(a), Government Code section 6254(c), or any other exemptions that the department plans on exercising in response to my request.

I would also like to ask if it would be possible to obtain records which show the date and time of when an employee becomes off duty, and the date and time of when an employee becomes on duty.

Thank you again for your response. I am still interested in completing this records request, and greatly appreciate your help throughout this process!

Best,
Bryan
