Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

- A copy of any data release consent forms students are asked to sign
- Any current policy documents or guidelines governing student data usage
- Any amendments made to those forms from 2015-2020
- Contracts, MOUs or other documents outlining any third-party programs or applications collecting student data

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

My apologies for the delayed response ... I have unfortunately been out of the office battling the flu.

Based on my review of your request, I am seeking further clarification in order to begin to process this request. Section 2.2-3704(B) of the Code of Virginia requires a request to identify records with reasonable specificity, and the list of examples you have provided, while appreciated, actually makes it harder for VMI to identify the records you are requesting. If you could please clarify the specific information you are seeking so that we may identify whether VMI has any records in its possession that are responsive to this request, we may proceed with processing this request.

Also, please note that VMI is permitted by Section 2.2-3704(H) to require the payment of an advance deposit prior to processing a request if it believes that the charges for producing the requested records are likely to exceed $200.

Good morning Lt Col Harrington,

This is a bit tricky. Generally, this request has been inspired by VCU adopting a wireless signal tracking program for students for attendance purposes. It raised questions about what students are being asked to sign with regard to the privacy of data such as email or cell info, and also what policies the university has in place around collecting or using that data.

This request has gone to several others and it's gotten both "this is too broad" and sets of documents related to policies and also forms. So I guess the key questions are: does VMI sell/rent or otherwise use student data (cells, emails, chip-IDs, ssns) and does VMI ask students to sign anything agreeing to that usage?

Hopefully this helps clarify the request, if not I'll work on it some more.

After review of our process and procedures with this regard, VMI does not sell/rent or otherwise use student data (cells, emails, chip-IDs, ssns) and VMI does not ask students to sign anything agreeing to that usage. I hope this helps to answer the specificity of your FOIA request.
