To Whom It May Concern:

Pursuant to the Florida Sunshine Law, I hereby request the following records:

Please supply all documents concerning the Lee Sheriff's filing of court papers seeking to obtain a court order that prohibits a citizen of Lee County from communicating with the sheriff to report crime and engage in core protected political expression (expression afforded the highest level of protection under the First Amendment), i.e. speech critical of government intending to create change.

Time period- Last 10 years

This is the conduct Sheriff Mike Scott and his successor continue to engage in which began with the Sheriff's filing for a protective order against a citizen of Lee County prohibiting the reporting of crime and access to any and all law enforcement services. See Huminski v. Town of Gilbert, et al, 17-CA-421, 20th Circuit, Judge Krier and Judge McHugh presiding.

Below is the docket entry concerning Mike Scott's motion to gag Huminski concerning Huminski's notification to the sheriff of the ongoing death threats issued by Justin Nelson (deceased-suicide), Trevor Nelson and Debra Riffel and collateral information occurring in civil litigation attempting to stop the death threats from the domestic terror cell in Arizona engaging in the interstate transmission of terrorist death threats into Lee County, Florida, both a Federal and State crime.

Motion for Protective order filed by Sheriff Mike Scott.

Docket Excerpt,
"03/29/2017 Motion
Defendant Mike Scott's Motion to Prohibit Plaintiff From Directly Contacting"

Attached see Mike Scott's Motion for contempt which was granted by the Court after urging from Sheriff Scott.

A sheriff can not exclude a citizen of the county he serves from public safety service or the reporting of crimes and reporting on the status of Court proceedings addressing the crimes.

This gag order migrated to County Court, by unknown behind the scenes methods that included forgery, Docket # 17-mm-815, and by order of Judge Adams remains in effect to this day and in its new incarnation in County Court, the order of Judge Adams simply states - "no communication" with the sheriff and, amazingly, the State of Florida. Sheriff Carmine Marceno can not seek or hold the position of sheriff to some of the citizens of Lee County, a sheriff must serve ALL citizens residing in the county. A sheriff seeking a gag order for certain citizens prevents him from holding or seeking the office of sheriff.

Please produce any similar documents issued by Sheriff Scott or Carmine Marceno for the last 10 years.

Additionally, please provide all documents related to Sheriff Carmine Marceno's attempts to remove the gag orders or that state his position on the gag orders from the start of his employment as sheriff to the present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

scott huminski
