Pursuant to the Florida Sunshine Law, I hereby request the following records:

All records and documents concerning when inmates are alerted to bunk assignments in the lee jails. Huminski was never told he was assigned to a bottom bunk and all LCSO staff observing Huminski never enforced the bunk assignments and neither were his roommates.

For the first 2 or 3 days in confinement, Huminski and 10 others in the pod slept on the floor as there were not sufficient bunks. When he arrived at D pod he was provide with a cell number but not top or bottom bunk and the existing resident had clearly been in the bottom bunk for several weeks and he was not alerted that he had to move to the top bunk. He had a latino last name and thick long hair and he was not told that his bunk changed.

Provide all documentation showing the the LCSO intervened in the bunk assignment or alerted the residents of bunk assignments.

Providing false information to law enforcement is a crime and with that in mind Huminski states he was never given a bunk assignment. Confronting another inmate concerning bunk assignments is dangerous and can lead to violence upon a fully disabled elderly citizen.

Bunk assignments are meaningless unless they are enforced. Past inmates all will confirm no bunk assignments are communicated to inmates.

Just like how the Lee Sheriff does not alert a patient that their life-sustaining medication that you have been on for 22 years is being completely ended putting one at risk of death and injury, the sheriff also maintains secrecy as to any assignment of bunks and no procedure exists for enforcement of bunk assignments.

The 2/13/2019 alleged medical record recently supplied is not in the original production of medical records supplied by the sheriff. I suspect fraud concerning this record. In either case, where-ever this document came from if it is not a fraud, these records are not supplied to inmates via any practice, policy or procedure adopted by the sheriff. Further what was supplied is a cut and pasted excerpt from a document that contains damning information that the sheriff wishes to keep secret.

While imprisoned, I asked the medical provider for my medical records and she denied the request. The medical records supplied related to these matters do not contain the cut and pasted bottom bunk directives.

In the Lee jails, bottom bunks are on a first come first serve basis and if there is a dispute the law of the jungle prevails -- might is right, where an elderly disabled person can not prevail regarding such confrontations with other inmates.

LEE SHERIFF supply the full document where the cut and pasted bunk assignment came from. Many times a cover-up is worse than the original transgressions. -- scott huminski

Mr. Huminski,
Our office will not process public records requests from @requests.muckrock.com until a seriously delinquent invoice is paid.  We completed a public records request and supplied an invoice to a "CJ Ciaramella" way back on November 12.  Although payment has been promised, Mr. Ciaramella/Muckrock has not followed through and is now (as of today) 70 days delinquent on payment.  Mr. Ciaramella/Muckrock has not responded to our last several communications requesting payment.
I have attached an excerpt from the Florida Attorney General which states that we are not obligated to fulfill public records requests from an organization (Muckrock) until previous public records requests have been paid in full.  I do not have any "contacts" at Muckrock.  I suggest that if you do, you alert them to the current situation.
