Copies of all complaints and reports filed against Kitsap County Juvenile, Superior and District Court Department employees, Guardian Ad Litems, Child Custody Investigators, Child Advocates, Judges, Administrative personnel, Police officers and Civilian staff from 01/01/13 to when this request is received.

Please include copies of all determinations (whether charges were filed)and outcomes.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To assist you with your search, I offer this contextual information:
Kitsap County Washington has an affiliate of the state’s Court Appointed Special Advocates (CASA) network. Kitsap is one of several selected Counties in Washington State where I am doing a comprehensive study of the Child Welfare System. Among other findings, this study resulted in discovering that a program affiliate in Snohomish County does nothing to make children safer, it was found that CASA prolongs foster care and reduces the chances children will be placed with relatives instead of strangers. In the case of the Snohomish County GAL Juvenile Court System Scandal there was One declaration alleging that after an attorney had made a complaint against a Snohomish GAL, the GAL upon finding out about the complaint, began a vehement witch hunt. Which included the recruitment of other members of the program as well as some law enforcement officials and judiciary administrative employees. Further, declarations also were submitted from foster parents indicating they made a complaint against a GAL … and were retaliated against.
These are the nature of the ‘complaints’ I am requesting in the instances where they would have been passed to or become knowledge of the prosecuting attorney’s office. In order to be comprehensive for the study, these records would include complaints or allegations filed against the departments and titles listed in my request and clarified below.

1. It appears that you are requesting complaints and reports filed with the Criminal Division of the Prosecutor’s Office for review for criminal charges, is this correct?

CLARIFICATION: Yes

2. The Prosecuting Attorney’s Office does not have the ability to search for cases reviewed for charging decisions based on a person’s job title. Such a search would have to be conducted by using an individual’s names. Do you have a list of names for whom you are requesting this information?

CLARIFICATION: This request is for ‘complaints filed’ or allegations of misconduct toward a “Department” regardless of identity of name for any misconduct of a judiciary officer or court appointed official. When composing this request, I assumed the personal identity would be sub-listed to the Department or nature of the complaint. Thank you for the records you have provided, I appreciate your time and effort. I have a question about the attachment providing explanation of exemptions and redactions. Maybe you can help me locate where in that document it calls for redaction of the allegations themself or redaction of the nature of the complaints. I also cannot find an exemption for the date the complaint was received- I assume the date on the redacted documents are the Prosecutors response date, I also need to know what date the complaint was received. I request general information about complaints whether or not they were charged.
What claims or charges were declined to prosecute. For example, "petty theft" or "unlawful entry" or perhaps "perjury" whatever the complaint alleges. I would not expect the names of the parties or the details of the cases, but I am looking for what the complaints are generally about. I Also am looking for the departments or administrations to which the complaints were directed, for example, "juvenile detention", "district court administration" "police department"

Also, wouldn't complaints that were prosecuted become public record once they enter the public court system? It is important to my study to know what types of complaints the Prosectors office charges and what they decline. I look forward to receiving these unnecessarily redacted portions of my request

Among other findings, this study resulted in discovering that a program affiliate in Snohomish County does nothing to make children safer, it was found that CASA prolongs foster care and reduces the chances children will be placed with relatives instead of strangers. In the case of the Snohomish County GAL Juvenile Court System Scandal there was One declaration alleging that after an attorney had made a complaint against a Snohomish GAL, the GAL upon finding out about the complaint, began a vehement witch hunt. Which included the recruitment of other members of the program as well as some law enforcement officials and judiciary administrative employees. Further, declarations also were submitted from foster parents indicating they made a complaint against a GAL … and were retaliated against.
These are the nature of the ‘complaints’ I am requesting in the instances where they would have been passed to or become knowledge of the prosecuting attorney’s office. In order to be comprehensive for the study, these records would include complaints or allegations filed against the departments and titles listed in my request and clarified below.

1. It appears that you are requesting complaints and reports filed with the Criminal Division of the Prosecutor’s Office for review for criminal charges, is this correct?

CLARIFICATION: Yes

2. The Prosecuting Attorney’s Office does not have the ability to search for cases reviewed for charging decisions based on a person’s job title. Such a search would have to be conducted by using an individual’s names. Do you have a list of names for whom you are requesting this information?

CLARIFICATION: This request is for ‘complaints filed’ or allegations of misconduct toward a “Department” regardless of identity of name for any misconduct of a judiciary officer or court appointed official. When composing this request, I assumed the personal identity would be sub-listed to the Department or nature of the complaint. Part of the study is to discover those names at which time I would follow up on that information.

Are you requesting that the Kitsap County Prosecutor’s Office provide the police reports and charging documents for any criminal complaints and reports referred to the Kitsap County Prosecutor’s Office regarding:

Please clarify what you mean by child advocates?

CLARIFICATION: Court Appointed Special Advocates for children and/or adults during guardianship proceedings. CASA workers, or any “title” where an employee or volunteer advocate is appointed to investigate and write a report to the Court or administrative department on behalf of a child or adult to assist in the determination, continuation, termination or any ruling considering guardianship.

CLARIFICATION: Yes

All Kitsap County administrative personnel? Please clarify what you mean by administrative personnel? Is this for all administrative staff in the County or is this limited to specific departments? What positions are you interpreting to be administrative personnel?

CLARIFICATION: Superior Court and Juvenile Court administrative employees who have had a complaint or alleged misconduct charge filed against them.

Please advise if your request, as it relates to police officers, is intended to mean all Kitsap County sheriff deputies or if it are you seeking information regarding police officers? If you are seeking information regarding police officers, please provide a list of the names for whom you are requesting information.

CLARIFICATION: Please interpret my request to mean; All Officers on payroll of Port Orchard Police Department.

All Kitsap County civilian staff? Please clarify what you mean by civilian staff? Is this a request for information regarding all employees of Kitsap County or by civil staff? do you mean all non-sworn employees of the Kitsap County Sheriff?s Office or do you mean something else?

CLARIFICATION: Civilian staff meaning “non-sworn” employees of Kitsap Superior and Kitsap Juvenile Court administrations.
