However, in order to ensure and adequate search for responsive records, we require clarification of search terms and interpretation of item 8 of your request., as this requires significant research and coordination with other departments to ensure the accurateness of our search. Regarding “money paid out in lawsuits and settlements”, we understand this to mean “an amount paid for property damage, bodily injury, or personal injury” (the three categories Risk Management uses for indemnity payments). This would therefore exclude matters where the county incurred some legal expenses in its defense, but did not settle or otherwise make payments to claimants, their lawyers, or their families; as well as claims where the county incurred no defense expense, such as a sustained denial of a claim by a Tort Claims Investigator.

Regarding the dates in the request, we understand this to mean, “last closed date between 1/1/13 and 12/31/20”.

With these two filters on payments and dates, KC Risk Management shows 359 claims against KCSO. Of these, 289 relate to auto liability, 43 relate to general liability, 22 relate to employment liability, and 5 relate to marine liability.

Identifying claims related for search term “officer misconduct” is unfortunately not a valid search term for an identifiable public record. KC Risk Management does not categorize claims as specific to “officer misconduct” because the term is too broad and not well-defined in this context. Therefore, we have attached a list of the 127 causes which can be assigned to a claim. Please review and the causes you are seeking from that list.
