Please provide:

(1) all (i) audio or visual records and recordings, or (ii) written transcriptions, notes, reports, or memoranda, or (iii) other information, about, in connection with, or of, any and all phone calls, emails, videos, or other communications made or received by detainees or inmates using any Securus phone or communication system, including without limitation the Securus Secure Call Platform or the AdvanceConnect Direct Bill, Traditional Collect, Inmate Debit, Jail Voicemail, Video Visitation, Securus Online, or Secure Instant Email, for any detention facilities operated by you, including without limitation the detention facilities set for below, and including without limitation records and recordings of:

(a) the content of the communication;
(b) the prisoners’ first and last names;
(c) the phone numbers they called or received calls from;
(d) the date, time, and duration of the calls;
(e) the inmates’ Securus account numbers;
(f) the metadata for the communication;
(g) the recording URL where the audio recordings of the calls can be downloaded; and
(h) any other information collected by Securus or you in connection with such calls; and

(2) all contracts, agreements, correspondence, documents, statements, writings and recordings of every kind (mechanical, electronic, typed or written) by and between the Missouri Department of Corrections or any other law enforcement agency and Securus, including but not limited to, letters, correspondence, memoranda, notes, audio recordings, reports, and transcriptions in the possession of, or subject to the control of you or Securus.

With regard to your item number 1, all inmate records, including email, audio and video communications are exempt from disclosure under RCW 70.48.100, “…the records of a person confined in jail shall be held in confidence…”. As such, all records requested in your item number one are exempt from disclosure.

Your item number 2 asks for all records between our agency and Securus. I have made the assumption that you are seeking every document, regardless of content or date, between Securus and DAJD. We have begun the process of researching and retrieving responsive records. I anticipate a first installment will be made available to you by March 4, 2014. This request is quite extensive and will require a significant search. As such, I anticipate a closure date of approximately July 1, 2016.

If your request is not as I interpreted, please let me know immediately so that I can revise my search parameters.

Dear Ms. Williams,

Thank you for your response. First, I apologize for the typographical error in subpart (2) referring to the Missouri Department of Corrections. That should have referred to the King County Department of Adult and Juvenile Detention.

I cannot find any definition of the term, "…records of a person confined in jail..." To the extent you know of any statutory interpretation or case law in connection therewith I would appreciate it if you could provide that to me.

As an example, the Clark County Law Enforcement Center states on its website, "JAIL RECORDS - Jail Records maintains the current and historical records of all persons booked into the Clark County Law Enforcement Center (CCLEC)... * A Jail Register is available to the public during office hours.  The Register provides information of the date, hour, and cause of each person that is confined and/or discharged at the jail. * General information on persons currently confined is available to the public.

To the extent King County has a similar policy or definition I would appreciate it if you could provide that to me. Similarly, to the extent the information requested is “General information” please provide it and redact any non-general information.

RCW 10.97.030(1) defines the term "Criminal history record information" as information contained in records collected by criminal justice agencies, other than courts, on individuals, consisting of identifiable descriptions and notations of arrests, detentions, indictments, informations, or other formal criminal charges, and any disposition arising therefrom, including acquittals by reason of insanity, dismissals based on lack of competency, sentences, correctional supervision, and release.

RCW 10.97.040 provides "No criminal justice agency shall disseminate criminal history record information pertaining to an arrest, detention, indictment, information, or other formal criminal charge made after December 31, 1977, unless the record disseminated states the disposition of such charge to the extent dispositions have been made at the time of the request for the information."

To the extent you construe part (1) of my request as "criminal history record information," RCW 10.97.040 appears to permit dissemination thereof so long as the disposition is stated.

Finally, because the phone call information requested is taken and retained indefinitely by Securus Technologies, Inc., a private company, and does consist of any of the information set forth in RCW 10.97.030(1), it would appear it falls outside the definition of the definition of “Criminal history record information.”

Please consider this a request for reconsideration of the denial of procution of the items set forth in subpart (1) of my request. In any event, I look forward to receiving more information about the initial production of items requested in subpart (2) of my request or before March 4, 2016.

Mr. Teel, as you requested, we have reviewed our decision to withhold records regarding your request for inmate telephone calls and all records associated with those calls. We cite RCW 70.48.100, http://app.leg.wa.gov/RCW/default.aspx?cite=70.48.100, as the regulation governing inmate records, which are records specific to an individual’s jail confinement. You referred us to RCW 10.97 which is specific to criminal records such as conviction and non-conviction data.

RCWs 70.48.100 and 10.97 govern two separate types of records. As your request was specific to inmate records, we again cite RCW 70.48.100 and deny the release of these records.

Our county website has a link to the “general records” regarding inmate bookings, charges, releases, etc. that you referenced in your last communication. You can access this information at any time via http://blue.kingcounty.gov/Courts/Detention/JILS/.

Thank you for your clarity and promptness in responding to my request. In light thereof, and without waiving any rights and remedies (all such rights and remedies are hereby expressly reserved), I would like to revise my request to see if the Dept. would be willing to provide the spreadsheet for the database which the Securus system provides with a reference simply as to whether or not the calls have been recorded. Perhaps we can reach an interim compromise which would provide some of the information requested and which may (or may not) obviate the need for the rest.

The Securus database contains the following columns:

As a compromise (again without any waiver implied), and in order to address your specific objection, I request that the spreadsheet database be redacted as to any objectionable identifier(s) about any person confined in jail so that the detainee's identity is held in confidence, and then be produced setting forth the dialed number, the destination zone, the start time, the end time, the duration, the call type, the term category, the amount, the taxes and fees, privilege status, Dtmf detect, Dtmf digits, and whether the call is liveconnect. In addition, I request a record simply indicating whether the call was recorded or not.

I wanted to update you regarding the portion of your request for a copy of the Securus database spreadsheet. There are approximately 6.2 million records since DAJD began using Securus (April 2014). With the Securus database, we are only able to extract 100 records at a time. Factoring in available staff and resources, I'm estimating this request to take several years to complete. We are working with Securus for a more efficient extraction process but are not hopeful one will be identified. I'll provide additional information as it becomes available to me.

I also want to inform you that we have email size restrictions which will require these records to be saved to disk and then mailed to you. The fee is $1/disk with an estimated postage fee of $1.64. The cost of every installment will be approximately $2.64. Please keep in mind, the postage fee may increase throughout the years. With monthly installments, I am anticipating the total cost of this request to be several hundred dollars.
You may expect to hear from me regarding your fourth installment of records by May 11, 2016. If you have any questions in the meantime, feel free to contact me.
