Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Memoranda of understanding (MOU's) regarding information sharing between King County Sheriff's Office and other entities (e.g., private businesses, trade associations, other police departments, fusion centers, federal agencies, etc.).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In an attempt to clarify which records I seek, I hereby narrow my request to the following records:

Memoranda of understanding (MOU's) regarding information sharing (the exchange of physical, analog, and digital data both public and non-public, gathered through King County Sheriff's Office resources and activities, regardless of transmission method) between King County Sheriff's Office and other entities (e.g., private businesses, trade associations, other police departments, fusion centers, federal agencies, etc.) and any agreements, binding or non-binding, to enter into or join groups, networks, or engage services providing information sharing of the same type. Information sharing in this context pertains to discreet information gathered about the public by the resources of the King County Sheriff's Office, not to information gathered internally about the King County Sheriff's Office for its own organizational, regulatory, or administrative reasons, and not to amalgamated statistical data provided to accredited academic entities for research purposes.

Dear Mr. Mocek:

Thank you for contacting the King County Sheriff's office. Our Records unit and then Legal unit received your email today for records through an email you sent to a Sheriff's Office email address yesterday, Sunday, July 14th . The email indicates that you originally made your request on April 18, 2013 and sent various emails after that to follow-up. However, none of those previous emails indicate to which email address at the Sheriff's office you used to send your requests. None of your prior requests were forwarded to the units that process public records requests until today. It is important for us to try to make sure that public records requests are forwarded properly to the units that them. Could you please send us the complete requests that you sent to us so we can track where the error(s) occurred? According to your email chain you sent today, you sent emails "to whom it may concern" On April 18, 22, May 15, 30, June 14, 29 and then yesterday July 14, but as I mentioned there isn't any header on those emails indicating the address to which they were sent.

For future reference, the Sheriff's office has a web-based public records request system that is available to the public 365 days a year 24 hours a day. You can access it via the King County Sheriff's office website at KingCounty.gov or google King County Sheriff's Office. Our face page provides a link to the form you can use to request public records. Your most recent email directs your requests to the Records unit and that is probably why it got routed to them. While you can send requests directly to the Records unit or to the Legal unit, using the on-line system probably the easiest way for you. Our website also has the addresses and contact information for both units.

As to your current request, we will place it into our on-line system and you will receive an acknowledgement of that for tracking purposes. I believe I understand the gist of your request -- which is a request for memorandums of understanding between the Sheriff' office and other private or public entities to share information the Sheriff's office gathers about members of the public. I am not entirely clear about the scope however since you have excluded amalgamated statistical data for accredited entities for research purposes. To clarify, do you want any memorandums regarding sharing non-identity based information? The example I am thinking of is that our office provides information to Crime Stoppers about certain crimes that occur in various locations in King County. Crime stoppers then posts that information on line. I am not sure if we have a written agreement about that but we can check. But I am wondering if you are interested in getting those types of agreements when the data is either aggegrated or identifying information is stripped.

I am sure we have a few agreements between other law enforcement agencies about sharing criminal justice information. I do not know if we have any agreements with private companies so we will have to check. We are a large agency and have a very high volume of public records requests with over a hundred pending before yours. We are currently needing to set out response dates to mid-September. If we can fulfill the request earlier we will.
