Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

All Stand Your Ground motions that have been filed by defendants in judicial district 16 since January 1, 2006.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Mr. Spies:

My office replied to your initial KORA request earlier today, May 4, 2017, by way of e-mail to 36313-49805935@requests.muchrock.com and by mail to the address you provided on your initial request. We also attempted to fax the response to you but the fax number listed at the top of your initial submission did not go through.

I have attached a draft copy of my response that was submitted to you within the three business days contemplated by KORA. My draft does not have our agency's letterhead at the top, but the content of the draft is identical to the content of the response that was mailed and e-mailed to you earlier today.

The highlights of that response included:

* We will be happy to look for the records you request, but can only provide records that we have from Ford County criminal prosecutions that my office initiated. There are a total of six counties in the 16th Judicial District, including Ford County. If you desire records from the entirety of the 16th Judicial District, you will need to contact those other county offices directly as my office does not maintain any official court records or any records for any other counties. My reply also included the contact information for those other county offices.

* Because you are asking us to review 10 years' worth of cases, some of which are on a computer database and some of which may only have a paper record, I am unable to comply with the request by the end of the third business day after receiving your request. I indicated that I anticipate I can have the information in our office's possession to you in the format you requested by May 10, 2017.

* I also indicated that I anticipated I would need to divert one member of my secretarial staff to assembling the information you requested, that I anticipated it would take her approximately six hours to review our computer and paper files and complete your request, and that her rate of pay was $12.4848 per hour.

If you have any additional concerns or issues, please let me know. Otherwise, rest assured we have received your request and are diligently working to fulfill it as soon as possible.
