Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

All Stand Your Ground motions that have been filed by defendants in judicial district 1 since January 1, 2006.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Mr. Spies:

We will have to deny your Kansas Open Records Act request. First of all, there is no one person who is the district attorney in the 1st judicial district. The first judicial district is made up of Atchison and Leavenworth counties. Your request should be addressed to the county attorneys for those counties. Second, county attorneys/district attorneys are not employees or officials of the Kansas Judicial Branch. They are elected officials of the county. As a result, you will need to address your KORA request to the proper party and send it to their email address or physical address.
