Pursuant to the The Kansas Open Records Act, I hereby request the following records:

1) Copies of all Predictive Model Reports provided to the university by EAB as part of its Student Success Collaborative product. These reports detail the predictive factors used to assign risk scores to students. A copy of an example report from another institution is attached for your reference.

2) All threshold reports provided to the university by EAB as part of its Student Success Collaborative product. A copy of an example report from another institution is attached for your reference.

3) Any differential impact analysis reports/studies compiled either by the university, EAB, or a third-party regarding EAB Student Success Collaborative's early warning system. These reports, sometimes called DIF or DIA studies, measure how the tools perform across different demographic or statistical groups.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you, Marc. I'm sorry to keep asking questions, but I just want to confirm:

The Kansas Open Records Act [45-218(f)] states that "[a] public agency may charge and require advance payment of a fee for providing access to or furnishing copies of public records." I'm willing to pay the fee you've described, but want to make sure that, in accordance with the law, my check will be cashed only if the records are actually provided.

I have been advised in this situation that there are some records.

Even if I was not sure, I would go ahead and put the check through. Early in my public entity life, I had someone try to stop payment on a check after we produced the records, so I act to protect my client first.

If the search resulted in no records found, I would have a check issued for a full refund.
