Pursuant to the The Kansas Open Records Act, I hereby request the following records:

[1] A list of all academic journals to which the university subscribed in the most recent available subscription period and the cost to the university for each such journal. For those journals that are part of a package deal, so no individual price exists, I request a list of these journals and the cost to the university of the package as a whole.

[2] For each academic journal to which the university subscribes, I request the most recent usage statistics provided to the university by that journal's publisher.

If the records for the University of Kansas Medical Center's subscriptions are kept separately and it would reduce the burden of this request to do so, please consider my request to exclude those subscriptions.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

On October 24, 2018, the University of Kansas received your email of the same date requesting records access pursuant to the Kansas Open Records Act (KORA). As required by KORA, the University is responding to your request within the third business day following its date of receipt.

Your request states, in relevant part:

The University of Kansas Medical Center (KUMC) is the custodian of their records. You may find the KUMC Custodian of Public Record's contact information, KORA submission procedures, applicable fee rates and other pertinent information at the following address: https://policy.ku.edu/kumc/kansas-open-records-act-procedure.

University personnel have been assigned to retrieve records responsive to your request; our goal is to produce available records in accordance with the law as quickly as possible. However, personnel limitations, precludes the records' immediate production as well as a total estimate of the fees incurred to produce them.

We will contact you on or before November 12, 2018, regarding the status of your request, at which time we may include determinations of availability and an estimate of fees incurred to produce available records. Please note that the University requires payment in advance for any documents produced.

On October 24, 2018, the University of Kansas received your email of the same date requesting records access pursuant to the Kansas Open Records Act (KORA). As required by KORA, the University responded within the third business day following its date of receipt on October 26, 2018, and promised further response on or before November 5, 2018.

To review, your request of October 24, 2018, states in relevant part:

Pursuant to the The Kansas Open Records Act, I hereby request the following records:

[1] A list of all academic journals to which the university subscribed in the most recent available subscription period and the cost to the university for each such journal. For those journals that are part of a package deal, so no individual price exists, I request a list of these journals and the cost to the university of the package as a whole.

[2] For each academic journal to which the university subscribes, I request the most recent usage statistics provided to the university by that journal's publisher.

The University charges all requestors in advance for the time required to retrieve, review, and produce available public records as allowed by K.S.A. ยง45-219(a). The University has calculated the following fee estimate for retrieval, review and production of the requested records:

$ 99.50 total estimated fees.

Please be advised that payment of the estimated fee is no guarantee that any records will be produced. Rather, this fee is an estimate of the time needed to retrieve and review the records to determine their availability under applicable law.

If you wish to proceed with this request, please send payment by check made payable to "The University of Kansas" in the amount of the total estimated fees and mail to my attention at the following address: Custodian of Public Records, University of Kansas, 250 Strong Hall, 1450 Jayhawk Blvd., Lawrence, KS 66045.

In the event that the estimate is less than the actual time required to produce the records, you will be invoiced for the balance of fees incurred prior to their production; if however, the actual time required is less than the estimate, you will be refunded any difference exceeding $5.00 (the minimum refundable amount).
