To Whom It May Concern:

Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, the Department of Administration is the agency in charge of coordinating the 1033 program for Kansas. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Mr. Fertig -

Thank you for your response. When would be a good time to discuss?

To clarify, I am requesting:

1) an inventory (such as the one attached as received from the Ohio state coordinator) of equipment received by Kansas law enforcement agencies from the 1033 program,

and

2) the current MOA between the Kansas state coordinator and the DLA Disposition Services.

Best,
Shawn

Todd -

Success! We were able to call with credit card info this morning.

Any idea of ETA on the data and MOA?

-Shawn

From: Fertig, Todd [DAPA]

Shawn,

I am hopeful that the provider of that info can have it to me Friday. He's in the field doing accountability checks, but I think he's trying to have it to me by then.

I'll keep you posted on ETA.

Todd

Any update on ETA?

Thanks again for your help on this request.

Shawn,

I am by no means trying to put you off. I am still waiting for the LESO program director and the Surplus Property director to get back to me with some answers.

But I have a new development:

I am getting word from Department of Defense that they (hopefully very soon) are making a database available to the public. I’m sure they have heard how many requests states are having to deal with.

I hope to know about it soon. When that database becomes available, I will send it to you immediately. Hold off a few hours and let’s see what I can get for you. If it appears to be good enough for your needs, I can refund your money.

Otherwise, I hope to get the LESO director back here this afternoon.

Sorry for the delay.

Todd

Todd -

Appreciate the update. For thoroughness, I'm requesting this from the Department of Defense as well as from the state coordinators individually. Thank you for your help!

Todd -

Sorry to bug, but checking to see if the LESO director needed any clarification on the request -- thanks!

I should have some response for you today. I apologize again for the delay.

Shawn,

Here is the list of weapons and vehicles which our agency is accountable for tracking through the LESO 1033 program.

Thank you for your patience.

Todd -

Thank you for sending this. It is my understanding that each state coordinator is responsible for completing a spreadsheet in the format of the attached Excel sheet released by the Ohio state coordinator. Please confirm whether such a spreadsheet exists for Kansas?

-Shawn

From: Fertig, Todd [DAPA]

I will see what I can find out.

Shawn,

We were able to come up with a similar list. Hope this gets at what you are looking for, or you can cross reference with the other list.

Thanks again for your tremendous patience!

Received. This looks like precisely what I was looking for.
