Pursuant to the Florida Sunshine Law, I hereby request the following records:

All documents pertaining to the city’s emergency plans for a heat wave or for extreme heat.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

I am in receipt of your request below. The information you are requesting is exempt under Section 119.071(3), Florida Statutes, and cannot be provided:

(3) SECURITY AND FIRESAFETY.—
(a)1. As used in this paragraph, the term “security or firesafety system plan” includes all:
a. Records, information, photographs, audio and visual presentations, schematic diagrams, surveys, recommendations, or consultations or portions thereof relating directly to the physical security or firesafety of the facility or revealing security or firesafety systems;
b. Threat assessments conducted by any agency or any private entity;
c. Threat response plans;
d. Emergency evacuation plans;
e. Sheltering arrangements; or
f. Manuals for security or firesafety personnel, emergency equipment, or security or firesafety training.
2. A security or firesafety system plan or portion thereof for:
a. Any property owned by or leased to the state or any of its political subdivisions; or
b. Any privately owned or leased property
held by an agency is confidential and exempt from s. 119.07<http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=0100-0199/0119/Sections/0119.07.html>(1) and s. 24(a), Art. I of the State Constitution.

Hello Craig:

I am writing to appeal your decision that Jacksonville's plans for extreme heat are exempt under Section 119.071(3).

The plan I am requesting is neither a security nor a firesafety threat plan. I am requesting any documents related to the city's plan for hot days or for heat waves.

In addition, every other city in Florida where I requested plans for extreme heat returned the appropriate documents.
