Dear Records Officer,

Pursuant to the state public records law, I am a journalist requesting that your law enforcement agency provide the following records. I have broken the request into two parts for your reference:

Part 1) Stolen Guns

It is our understanding that law enforcement agencies keep detailed records about firearms that were reported stolen in their jurisdictions. This information is often held in an internal crime analysis and research database that can be queried for specific property.

We are therefore requesting the following for each case of reported firearm theft in your jurisdiction from Jan. 1, 2010 to the present:

-- The serial number, make and model of each firearm that was reported stolen
-- The police report number and/or incident number for the firearm theft
-- The date the theft was reported

I would appreciate if your agency provided this information in a spreadsheet or list. If a spreadsheet or list cannot be provided, please provide copies of the police reports, incident reports, or offense reports for each case of reported firearm theft during that timeframe.

Part 2) Property and Evidence Guns

It is our understanding that law enforcement agencies maintains detailed records about firearms that were seized, confiscated, recovered, found, turned in, or otherwise came under the custody and control of the department. These guns are processed and booked into Property and Evidence and details about each are entered into a database.

We are therefore requesting a spreadsheet or printout of every such firearm entered from Jan. 1, 2010 to the present. The records should include, but not be limited to, the following:

-- The serial number, make and model of each firearm
-- The date on which the firearm was entered
-- The police report number and/or incident number associated with each firearm
-- If readily available, the type of crime or incident involving each gun (e.g., homicide, robbery, assault, etc.)

If a spreadsheet is available for either part of this request, we respectfully ask the department to provide the record layout and/or code sheet so that we can ascertain the meaning of column labels, acronyms and abbreviations, and distinguish between firearms reported stolen and those that were seized, confiscated, recovered, found, turned in, booked into property and evidence, or otherwise came under the custody and control of the department. If a spreadsheet is not available, please provide any and all other records that will yield the information we are seeking.

I am a member of the news media, a reporter with The Trace, a 501c3 nonprofit news organization headquartered in New York City. I am making this request through MuckRock’s public records request management service.

We will be making information obtained from this request available to the general public and are not requesting it for commercial purposes.

In the event that there are fees, I would be grateful if you informed me of the total charges before completing my request.

I would prefer the requested information be sent via an e-mail attachment if available, or a mailed CD-ROM if not. You can send any correspondence or records by responding to this email or sending them to my company email: foia@thetrace.org

If you require standard mail, we ask that you send correspondence and any records to our national headquarters at:

Hello Mr. Freskos,

I have received your request for a spreadsheet of all firearms stolen from 2010 to now. I must inform you that the spreadsheet will not include the serial numbers of the stolen weapons, per our agency police we do not disclose that identifier.

Before I can process this request we will need to receive your $75 deposit. Please make the check out to the Jackson County Sheriff's Office. And you can send that check to our office located at 5179 Crater Lake Highway, Central Point, OR, 97502. That increased cost is due to the time it will take to process your request. (To complete part 1 of your request will require at least 3 hours of my time.)

Part 2 of your request will need to be processed by our Property & Evidence Clerk, and I will forward your request to her.

Thank you,

Sarah Jagger

Hi Sarah,

Thank you for your help with this request! We'd be happy to pay the $75. However, I may not be able to get much more money than that for this part of the request. Can you advise whether the final cost will be much more than $75?

Also, on the serial numbers, I understand that the withholding of serial numbers is a department policy? Can you put me in touch with whomever enforces that policy? Maybe the legal department? I would like to get some more clarification on the application of this policy, as we have received serial numbers from every law enforcement agency in Oregon that has so far responded to our request.

Hello Mr. Freskos,

I am currently out of town for a Crime Analysis training for the week. Before I left I was working on your request.

I waited to hear back from the county's legal council in regards of to the release of the stolen gun serial numbers. I was given the approval to release the serial numbers of the guns in closed cases, but if the case is still open and ongoing I am not allowed to release the serial numbers.

As to the price of the report, I have currently spent 5 hours of my time building and researching this request and estimate it will take no more than 5 more working hours. The total of the request will be $150. And the report will be finished by the time we receive the check.

Thank you for your patience.

Sincerely,
Sarah Jagger
