Pursuant to the Iowa Open Records Law (Code Chapter 22), I hereby request the following records:

The following materials regarding the assessment, collection, and balances of inmate fees and debt:

• All policies and procedures regarding the goods, services, or any other expenses for which inmates are or may become liable. Please include all policies on the garnishment/disbursement of funds from inmate accounts and wages (such as those related to mandatory saving, mandatory deductions, coverage of care, personal necessities, etc.), as well as all relevant reporting requirements. Please include all relevant data as regards to medical payments, room and board costs, meal fees, stamps and postage, hygienic materials, and any other expenses for which inmates are or may become liable, etc.

• All reports, databases, spreadsheets, or equivalent materials regarding current debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction. Please include all available segregable information (excluding individual personally-identifying elements, as necessary and appropriate), including but not limited to the reason for the debt/fee, the amount of the debt, the facility at which the debt was incurred, whether the debt is held by an inmate in custody or released, any available individual data regarding record of prior release, etc.

If further clarification is necessary, a phone call will happily be arranged.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Sir/Madam,

Offenders within the Iowa Department of Corrections are responsible for any numbers of deductions from their offender account for expenses relating to restitution, court filing fees, child support, institutional sanctions – along with any other number of potential expenses. All policies and procedures of the IDOC are located on their website and can be viewed on that website. http://www.doc.state.ia.us/Policies Therefore, in response to your request for such polices, please view the information provided on the website.

You had also requested “all reports, databases, spreadsheets, or equivalent materials regarding current debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction”. The request is very broad and a detailed response to such a broad request would be difficult to provide. However, if you would like to narrow the search, a response may be possible. For example, information relating to restitution collected during a particular year would be easily obtainable, but a list of all potential debts and payments would be difficult. So, please narrow the search request and we can provide an estimate as to the time and costs associated with completing such a response. Please contact me if you have any questions.

Hello Mr. Scaletta,

Thanks for the clarification. Would it be possible to receive something along the lines of the monies paid to the Department for those categories instead? So rather than how much debt is being currently held, perhaps there might be reports on how much the Department garnished from inmate wages for any purpose or how much was collected for medical co-payments, etc.? This may not speak to the way in which these materials are organized, so I'm happy to discuss further how to reorganize this request.

Here is the information you requested. Sorry for the delay.

Medical Co-Pay: We charge $3.00 each time, but if an offender leaves and has a negative balance we write that off which would explain why this isn’t an even amount. For example, if an offender was $2.20 in the red after they left custody we would void the $3.00 transaction but charge back $.80 to bring the balance to zero.

Administrative Fee: This fee is for offenders who attempt to overspend his/her account. This is a $5.00 fee and again if an offender leaves we may write a portion of it off to bring the account balance to zero.

DOC Sanctions: This is the total amount collected for disciplinary sanctions. It needs to be noted that not all sanctions are payable to the department. For example, if an offender has stolen or damaged something that belongs to another offender the sanction would be payable to the offender who had those damages.

Pay for Stay: This is the 6% surcharge that offenders pay on things like outside orders and commissary. Certain items are exempt from pay for stay such as postage and certain religious items. That is addressed in AD-FM-11.

These are the only fee based items that I am aware. The other things the offenders are charged for are simply reimbursements for items such as postage, copies, etc.
