To Whom It May Concern:

Pursuant to the Iowa Open Records Law (Code Chapter 22), I hereby request the following records:

All complete records of property transmitted to the Treasurer of the State following the death of an inmate.

[For reference: https://coolice.legis.iowa.gov/Cool-ICE/default.asp?category=billinfo&service=IowaCode&ga=83&input=904]
"904.509 MONEY DEPOSITED WITH TREASURER OF STATE.
Money from property converted pursuant to section 904.508 shall be transmitted to the treasurer of state as soon after one year after the death of the inmate as practicable. A complete permanent record of the property, showing by whom and with whom it was left, its amount when converted to money, the date of the death of the owner, the owner's reputed place of residence before becoming an inmate of the institution, the date on which the money was sent to the treasurer of state, and any other facts which may tend to identify the decedent and explain the case, shall be kept by the superintendent of the institution, and a transcript of the record shall be sent to and kept by the treasurer of state.
Money deposited with the treasurer of state pursuant to this section shall be paid at any time within ten years from the death of the inmate to any person who is shown to be entitled to it. "

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The documents being requested are a vital component of an ongoing journalistic investigation of public-private corrections partnerships, a critical element in the current discussion of our criminal justice system. The materials will be made available to the general public free of charge as part of the public information service at MuckRock.com and will by analyzed and contextualized by a representative of the news media/press. This request is made in the process of news gathering and is not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Beryl C.D. Lipton

Mr. Lipton,

I am in receipt of your Freedom of Information Request dated July 6, 2015. Our initial review of our records indicate that we do not have records that fit your request, but we intend to conduct an additional search to verify that. Our goal is to have that search completed by mid-week next week. I will be back in touch at that point. Thank you.

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on July 6, 2015. Please let me know when I can expect to receive a response, or if further clarification is needed.

Thank you for your help.

Mr. Lipton,

Our office did not receive any information with unclaimed property reports that would indicate if the source of the unclaimed funds were subsequent to the death of an inmate. You may want to reach out to the Department of Corrections and see if they have any information related to this request. Thank you.
