Re: Records Request

Dear Ms. Raih:
This letter acknowledges your June 14, 2017, request for records pursuant to the Access to Public Records Act (“APRA”). Specifically, you requested the following:

· Amount of TANF money allocated to alternative to abortion programs and services and a list of corresponding agency recipients.

· Any documents that outline Indiana's plan on how this program is meeting at least one of the four federal requirements – “providing assistance to needy families, promoting job preparation and work, preventing and reducing out-of-wedlock pregnancies, and/or encouraging marriage and two-parent families”.

· Any notification sent to Health and Human Services regarding policies changes made at least 30 days before hand.
Under the Indiana Access to Public Records Act, agencies must acknowledge an emailed request within seven days of its receipt but are not required to provide records within that time period. This email serves as acknowledgment of your request within the legally mandated timeframe under Indiana Code § 5-14-3-9.
ISDH is currently reviewing its records to identify documents responsive to your request. We will try to produce all records as quickly and completely as possible. The Indiana General Assembly has provided public agencies discretion as to whether to disclose certain records under Indiana Code § 5-14-3-4(b). We will make requested disclosable records available on a case-by-case basis as permitted by statute. If we deny disclosure of a record or records, we will cite the specific exemption that authorizes our office to withhold a specific record pursuant to Indiana Code § 5-14-3-9(d).
As we currently have several other open APRA requests at this time, we appreciate your patience in advance as we work to complete your request.
Indiana Code § 5-14-3-8(b) provides for a copy charge of ten cents ($0.10) per standard sized (8 ½” x 11”) pages copied, fifty cents ($0.50) per ledger sized (11” x 17”) pages, and $1.00 for plan sized (24” x 36”) pages copied. Once we know what records are available in response to your request, we will notify you of any charges prior to sending you the records.

Sincerely,
Jeni O’Malley

The Indiana State Department of Health does not report to Health and Human Services for TANF purposes because the Indiana Family and Social Services Administration (FSSA) administers TANF funds. Please contact Jim Gavin, director of communications at FSSA, at jim.gavin@fssa.in.gov<mailto:jim.gavin@fssa.in.gov> to determine whether FSSA has records relevant to your request.

Sincerely,
Jeni O’Malley
