Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

• All policies related to the employment and payment of incarcerated persons under the jurisdiction of this agency.

• The most recent report regarding currently-employed incarcerated persons under the jurisdiction of this agency. Please include all available segregable information, including the type of employment, the wage at which the employment occurs, and any other applicable information. Please do not include any personally identifying information.

• All reports regarding post-incarceration employment for individuals formally under the jurisdiction of this agency.

If no such reports exist and if reports with equivalent information also do not exist, confirmation of the fact that no data at all exists on this subject will suffice.

Good Afternoon,

You have requested (1) All policies related to the employment and payment of incarcerated persons under the jurisdiction of this agency, (2) The most recent report regarding currently-employed incarcerated persons under the jurisdiction of this agency, (3) All reports regarding post-incarceration employment for individuals formally under the jurisdiction of this agency.
Firstly, please see the three attached policies in regard to offender employment.

For request (2), IDOC could provide general data regarding incarcerated offender employment numbers if reasonable specificity is applied. Indiana’s public records law (APRA) requires a request for public records to be made with “reasonable particularity.” Indiana’s Public Access Counselor (PAC) has published numerous advisory opinions on the topic of reasonable particularity. This is necessary for any agency to correctly and efficiently locate and disclose records responsive to a request. Please provide specific facilities, dates, times, and keywords, whenever possible. A request will need to be narrowed for the Department to complete a productive search.

To be clear, your request is not being denied but requires reasonable particularity in order to narrow the search of the data requested.

Lastly, (3) The requested report records does not exist. Under the Advisory Opinion of the Public Access Counselor 16-FC-128 documents do not have to be created upon request and therefore the request is denied.
