Thank you very much, I had believed that this was sent to the Governor's office.

Would it be possible to change my request for the emails of Chris W. Cotterill from January 1, 2014 to Present day containing any of the following non-case-sensitive key-strings: "EB-5", "EB5", "Regional Center", or "USCIS".

Thank you,
Taylor Amarel

From: Office of the Governor

From: Taylor Scott Amarel

Please forward my request to the Indiana Economic Development Corporation (“IEDC”). Furthermore, I am not requesting "everything", I am requesting precisely described emails that can be easily searched and sorted using basic electronic email management systems.

From: Office of the Governor

Mr. Amarel,

Please see the attached for the IEDC’s response to your public records request dated June 8, 2018.
Best,

To whom this may concern,

I respectfully appeal this decision. Your quote is in reference to a subpoena and not related to the Indiana Access to Public Records Act.

Furthermore, other Indiana agencies, state agencies, cities, and federal agencies have all determined via appropriate interpretation of the statute and case law that the search for records via keystrings is not unreasonable, in fact, doing a record search via keystrings is more easily done and more precisely described than searching paper files.

Could you please accept this as my appeal and re-evaluate the response.

Best,
Taylor Amarel

From: Taylor Scott Amarel

To whom this may concern,

I disagree, the records requested are precisely described in a manner that is easily translated into an electronic email search. The act of searching electronic records, specifically emails, is something that almost every public employee knows how to do and likely does on a daily basis.

Further, the Supreme Court case that you cited has to do with a "subpoenaed party" and not the Access to Public Records Act (“APRA”) (Ind. Code 5-14-3).

For more information on the appropriate way to fulfill the obligations of the APRA, I would invite you to review this guidance document: https://www.in.gov/pac/advisory/files/formal_opinion_09-FC-24.pdf

Please let me know if you have any questions, I do not believe there is any valid reason to deny these documents and similar requests have been successfully completed by other state agencies.

From: Taylor Scott Amarel

I also want to point out that other media agencies have obtained access to similar records, which can be seen here: https://www.cjr.org/united_states_project/indy_star_pence_emails_public_records.php

From: Taylor Scott Amarel

To whom this may concern,

In addition to my previous requests and the subsequent appeal. I would like to submit a request for all email records sent between Secretary of Commerce Victor Smith and Mike Pence, from January 1, 2016 to June 1, 2016 containing any of the following non-case-sensitive key-strings: "Eb-5", "USCIS", "Regional Center", "liberals", or "Whistleblower".

This request precisely meets the requirements set out within this document: https://www.in.gov/pac/advisory/files/17-FC-52.pdf

Best,
Taylor Amarel
