To Whom It May Concern:

Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

1. Electronic copies of any email correspondence exchanged between the Attorney General or First Assistant Attorney General, and any of the following external individuals or companies (listed below), from September 19, 2017 to the present.

To make this search easier, I am including the email addresses or domains of the external individuals or companies, listed here:

MULTISTATE ASSOCIATES INCORPORATED @multistate.com
TAFT STETTINIUS & HOLLISTER @taftlaw.com
KEILMAN, THOMAS thomas.keilman@bp.com, tom.keilman@bp.com
FERGUSON, MAUREEN maureen.ferguson@api.org
BEHRENS, MARK mbehrens@shb.com
MCKENNA, ROBERT rmckenna@orrick.com
KOCH INDUSTRIES @kochind.com, @kochcareers.com
U.S. CHAMBER OF COMMERCE @uschamber.com
AMERICAN FUEL & PETROCHEMICAL MANUFACTURERS @afpm.org
BP @bp.com
CONOCOPHILLIPS @conocophillips.com
CHEVRON @chevron.com
EXXONMOBIL @exxonmobil.com

2. Electronic copies of any email correspondence, sent to or received by the Attorney General or First Assistant Attorney General from September 19, 2017 to the present, which includes the following keywords (listed below).

Keywords:

British Petroleum
BP
ConocoPhillips
Conoco
Chevron
ExxonMobil
Exxon
Royal Dutch Shell
Hagens Berman
Hagens
Matthew Pawa
Matt Pawa
Pawa
HBSS

For both of the above requests, please include any attachments that were a part of these files, such as Word documents, or PDFs or other types of attachments. Please also include copies of emails in which any of the employees listed above were simply “cc-ed” or “bcc-ed.”

Because the above searches involve a limited number of individuals within your office, a defined period of time, and a narrow set of outside parties and keywords, these should hopefully constitute simple electronic searches.

I acknowledge that not all government-held information is open to the public. Simply because correspondence is from a lawyer, however, does not mean it is exempt under the attorney work-product privilege provision. General correspondence with the AG or any deputies, or even correspondence that references a specific company, should not be covered under this exemption.

If you have any questions about this request, please contact me immediately, as I am more than willing to discuss perhaps revising the request to make it easier and faster for you to respond to it. For your information, a similar request is being made of other state AG offices.

Given how narrowly the above requests are crafted, I hope it is something you can respond to by May 2. If your review is not complete by then, I would ask that you provide whatever material you have compiled by this date, and then send a more complete response once you have finished your review of the requested materials.

As a journalist making this request for documents that will be made available to the general public and not used for commercial purposes, I ask that you grant a fee waiver for this request. In the event that there are fees in excess of $30, I request that you inform me of the total charges in advance of fulfilling my request. I would prefer the request be filed electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your assistance. I do realize that responding to requests like this requires staff time and I appreciate you taking this time to address my request. I look forward to receiving your initial response to this request within 7 business days.

Sincerely,

Phil McKenna
