Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

All memos, budgets, proposed budgets, presentations, and emails from the dates 01/01/2012 to 04/09/18 mentioning the use of, spending on, and/or consideration of bulletproof shelters for use in schools in the state.

An example of one such company that produces bulletproof shelters is the company called Shelter in Place (http://shelterinplace.com/pricing), mentioned in this local media report, among others covered in the press in various states: http://abc7ny.com/is-this-bulletproof-school-shelter-the-new-normal/3160640/

I am a member of the press and therefore request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Mr. Franco,

After review of your request, it was determined the Department does not maintain the records you are requesting. Under the Access to Public Record Act (APRA), an agency is not required to produce a copy of a record it does not maintain. See Opinion of the Public Access counselor 01-FC-61; see also Opinion of the Public Access Counselor 08-FC-113 ("if the records do not exist, certain the [agency] could not be required to produce a copy....").
