Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

Records pertaining to all driver's license suspensions since Jan. 1, 2008 in Illinois. These records should include the following information:

1. The name, age, sex, date of birth and address of the driver whose license was suspended
2. The reason the driver's license was suspended (violation)
3. The date of suspension
4. The current status of the driver's license (e.g., license reinstated, license still suspended, etc.)

I understand that some information on licensed drivers in the state is protected under statute, however, I am requesting information on suspensions because the state's web site indicates this information may be subject to public release upon request. Specifically, the state's web site states that, "Public information that can be released includes convictions, withdrawals and crash information." If your office determines that some but not all of the above information is subject to release, please respond with the portion of the request that may be released rather than denying the request in full. I would also appreciate if this information could be conveyed in spreadsheet format, where each row is a suspension incident and each column corresponds to one of the above pieces of information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Mummolo:

This email is to acknowledge the receipt of and to respond to your FOIA request dated May 13, 2019. In that request, you ask the Secretary of State to provide you with a list of all driver's license suspensions from January 1, 2008 through the present that includes:

1. The name, age, sex, date of birth and address of the driver whose license was suspended;
2. The reason why the driver's license was suspended;
3. The date of the suspension;
4. The current status of the driver's license.

The Secretary of State has reviewed your request and has determined that it is prohibited from compiling the requested list pursuant to 92. Ill. Adm. Code 1002.70(b). This Section provides as follows: "Lists shall not be available by any type of driver's license sanction; i.e. suspension, revocation, cancellation or denial."

Given that the Secretary of State is statutorily prohibited from compiling the requested list, the information requested is exempt from production pursuant to Section 7(1)(a) of the Illinois Freedom of Information Act [5 ILCS 140/7(1)(a)].

Should you wish to do so, you may file a request for review with the Office of the Illinois Attorney General, Public Access Bureau, 500 S. Second St., Springfield, Illinois 62706.
