Mr. Chapman,

Attached is a spreadsheet of the current list of active Reciprocal Agreements on Exchange of Information pursuant to the Illinois Retailers' Occupation Tax Act, the Service Occupation Tax Act, the Use Tax Act, and the Service Use Tax Act (the "Tax Acts"), in response to your Freedom of Information request received in our office on May 30, 2018.

The spreadsheet contains the local government name (municipality or county), date the agreement was received, and the date the fully executed agreement was acknowledged by the Department. There are two agreements on the list that do not have an acknowledgement date, as they are still being reviewed by Department staff.

There are 371 agreements on the list. Due to the number of agreements, and the fact that the only information that differs from these agreements beyond what has been provided in the spreadsheet are the signatures, the Department has determined it would be unduly burdensome on its operations pursuant to FOIA section 3(g) (5 ILCS 140/3(g)) to scan, review, and redact copies of the signed agreements. Signatures are private information exempt from disclosure as defined in section 2(c-5) of FOIA (5 ILCS 104/2(c-5)), and are redacted from records provided under FOIA pursuant to section 7(1)(b) (5 ILCS 140/7(1)(b)).

The Department invites you to narrow your request to a specific municipality's or county's agreement, which we would provide with the redaction of private information (i.e. signatures). To the extent that you do not wish to narrow your request, we hope that this spreadsheet will satisfy your request.

To the extent you consider this response to be a denial of your FOIA request, you have the right to submit a request for review by the Public Access Counselor (the "PAC") in the Office of the Illinois Attorney General to:

Thank you for this info -

WRT narrowing, would it be possible to just include the municipality or county's department that signed each reciprocal agreement? I am interested in knowing the department name of those that signed, which would not include a signature.

If that would be considered unduly burdensome, then please reduce the scope down to signed documents at the county level for Cook County. Following the same reasoning, if county level is unduly burdensome, then please reduce the scope to Chicago.

The reciprocal agreements are required to be signed by the chief executive officer of the county or municipality.

The City of Chicago does not have a current reciprocal agreement on file.

A redacted copy of the Cook County reciprocal agreement is attached. Signatures have been redacted as private information pursuant to 5 ILCS 140/7(1)(b). The agreement was signed by Toni Preckwinkle, Chief Executive of Cook County.
