From: Joseph Uchill

To Whom It May Concern:

Pursuant to the Idaho Public Records Act, I hereby request the following records:

According to the Associated Press (Feb 15 - https://www.usnews.com/news/idaho/articles/2017-02-15/idaho-official-dhs-may-have-tried-to-hack-elections-site) The Idaho Secretary of State believes a federal agency may have tried to hack the state's election website around the date of the presidential election without notifying Idaho officials in advance.
The U.S. Department of Homeland Security's IP address showed up as trying to access the state elections site around Nov. 8, Secretary of State Lawerence Denney said Monday...."I don't know what they penetrated, or what they tried, I just know their IP address showed up as hitting our website," said Denney. "I don't know what they were doing. It would have been nice if they had told us."

Please provide:
(1) Technical reports, after incident reports and any other internal or externally produced reports concerning that or any other alleged hack of Indianan technology from DHS.
(2) All emails, memos, letters, communications and presentation slides discussing the incident.
(3) Expense reports for services to investigate the attempts to breach.
(4) Emails, memos, reports or other communications discussing potential civil or legal actions against the DHS.

If it would help with clearance rates or efficiency please feel free to refile each bullet point as a separate request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Joseph Uchill

From: Idaho Secretary of State

As required by Idaho Code ยงยง 74-101 through 74-126, this letter is a response to your request for access to public records, which was received by this office on November 17, 2017. You specifically request the following:

1. Technical reports, after incident reports and any other internal or externally produced reports concerning that or any other alleged hack of Indiannan technology from DHS.
2. All emails, memos, letters, communications and presentations slides discussing the incident.
3. Expense reports for services to investigate the attempts to breach.
4. Emails, memos, reports or other communications discussing potential civil or legal actions against the DHS.

At the direction of the Deputy Secretary, I have the following information to report back to you at this time.

1. Technical reports, after incident reports and any other internal or externally produced reports concerning that or any other alleged hack of Indiannan technology from DHS. - YOU HAVE REQUESTED INDIANA. ASSUMING THAT YOU MEANT IDAHO, THERE IS ONLY ONE INCIDENT TO WHICH YOU COULD BE REFERRING, WHICH WAS LARGELY MISREPRESENTED IN THE PRESS. THERE ARE NO REPORTS OF ANY "HACK" BY DHS. WE WERE ABLE TO MATCH MULTIPLE ATTEMPTS TO ACCESS A SEARCH QUERY IN A CONCENTRATED PERIOD OF TIME ON AN IDAHO SOS ASSET BY A DHS ADDRESS. THIS IS CONSIDERED SUSPICIOUS ACTIVITY DUE TO THE NUMBER OF ATTEMPTS AND THE TIMEFRAME OF THOSE ATTEMPTS. THIS WAS NOT ON AN ELECTIONS ASSET.
2. All emails, memos, letters, communications and presentations slides discussing the incident. AS THE INCIDENT YOU SPOKE OF ABOVE WOULD PERTAIN TO INDIANA, THERE IS NOTHING TO PROVIDE. IF IN FACT YOU ARE STILL INTERESTED IN THE PARTICULAR INCIDENT NOTED ABOVE, PLEASE SUBMIT A NEW REQUEST SPECIFYING SUCH.
3. Expense reports for services to investigate the attempts to breach. NO EXPENSES TO REPORT
4. Emails, memos, reports or other communications discussing potential civil or legal actions against the DHS. NO RECORDS TO REPORT.

Thank you, and again, if you are still interested in further information, you may submit another request specific to the event noted above, and/or contact the Deputy Secretary directly. His email is above.

From: Joseph Uchill

Yikes. Well, you can take solace in knowing this means I sent my Idaho letter to Indiana.

I am an idiot and will refile.

Thank you for your help and my apologies for misidentifying the Gem State. Though I can't think of a state whose name I'd enjoy getting wrong, Idaho wouldn't crack my top ten.

From: Joseph Uchill

Inasmuch as I didn't formally say you can consider this Indiana-befouled matter completed, I figured I'd send you a note specifically saying so.

Please close this FOIA.
