From: Brian Waters

To Whom It May Concern:

Pursuant to the Texas Public Information Act, I hereby request any lists or databases regarding the credibilty of police officers. Such lists are common in many jurisdictions, and go by names such as "Giglio lists," "Brady lists," "bad cop lists," "police credibility lists," or "do not call lists." Please provide the list in its entirety, which should include, at a minimum, the name of each officer on the list, and information about why the officer is on the list.

Furthermore, I am requesting any other records that refer to or discuss said lists, such as policies regarding when or how officers are added to the lists, when and how officers are removed, and how the lists are used.

For reference, I have linked two news articles which describe such lists in New York and Philadelphia:
http://gothamist.com/2019/04/22/district_attorney_cop_lists.php
https://www.philly.com/philly/news/larry-krasner-philadelphia-police-tainted-misconduct-secret-list-20180306.html

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Brian Waters

From: Brian Waters

Ms. Stevens,

Thank you for your response, and thank you for including disclosure policies which are responsive to the second part of my request. However, I hope you will forgive me, as I am a bit confused as to the status of the first part of my request, in which I asked for your office's Brady lists themselves. You attached a letter from your office to the Attorney General's office, asking them to please find an appropriate Public Information Act exemption for the lists. Should I consider this a denial of the first part of my request, or should I expect a response in the future? If it is a denial, could you please explain what specific exemptions are being invoked?

Thank you, and sorry for the confusion,
Brian Waters

Hi Brian – We will be sending up more detailed correspondence to the Attorney General next week.

The letter we sent to you yesterday is our initial request for a determination from the Attorney General to determine whether the requested information is public information, or whether it is exempt from public release.

The next letter will explain our arguments in detail that the database information is not subject to public release. I will send you a copy of that correspondence and you may also make arguments to the Attorney General.

After you review our detailed comments which will be sent next week, please contact me if you have questions or to discuss.
