Thank you for the response. Yes, I am referencing the enforcement of those categories. I do not want to burden the department, I would consider 10 business days from 8/13/19 to be a reasonable amount of time. I would expect completion on 8/27/19.

From: Houston Legal Department

We apologize for the confusion, but when we asked for the timeframe that you want this information, we were asking if you are looking for records within a particular time period. For example, do you want records from this year or the last 5 years, etc.? Please clarify if there a particular time period that you are seeking records.

Please note that Section 552.222(d) of the Texas Government Code authorizes the City to consider your public information request withdrawn as a matter of law if you do not respond in writing to this request for clarification within 61 days from the date of this correspondence.

Dear Mr. Adkins:

The City of Houston Legal Department is in receipt of your request. Please note that we will be seeking a ruling from the Attorney General’s Office for the portion of responsive information that is housed in our department. However, please note that the Legal Department is not the custodian of records for a portion of the responsive information. This is to notify you that the Texas Public Information Act (Texas Gov't Code §552.301) requires requests for public information submitted by either facsimile or electronic mail to be submitted to the officer of public information (or the person designated by that officer) before they are to be considered proper written requests. Tex. Gov’t Code §552.301(c). The Legal Department is not the custodian of records for the General Orders that guide how Houston Police Department Officers should interact with homeless citizens.

You may want to forward your request for that portion of the responsive information to the Houston Police Department’s Office of Planning & Data Governance. Their email address is hpd.openrecords@houstonpolice.org<mailto:hpd.openrecords@houstonpolice.org>.
