From: Beryl Lipton

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

* All maps of pipeline facilities (services, mains, regulators, etc.) provided by utility companies, including details regarding the age or dates of the installation of the pipeline, the material of the pipeline, and whether the pipeline is high pressure or low pressure. If you have these maps in shape files or in arc GIS, those formats are preferable.

* The most recent inventory of outstanding leaks on the distribution system within the boundaries of municipality, including the location of the leak, date the leak was identified/classified, the grade of the leak, whether the leak has been reclassified or designated for repair, and the date on which the inventory was compiled.

* The list or map of pipeline segments currently scheduled for replacement.

This information should be available to the municipality as required by Massachusetts General Laws, Chapter 164, Section 144 (https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXXII/Chapter164/Section144).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Beryl Lipton

Dear MuckRock News:
As a follow-up to my last correspondence dated October 29, 2014, this
office holds files relative to your request, if in fact, they can be made
available to the public. If they are for public viewing, the "good faith"
estimate cost to copy these records (MGL, Ch. 66 Sec. 10) would be .20
cents per page along with costs associated with microfilm copies at .25
cents per page and .50 cents per page for computer printouts. There is
approximately a minimum of 2,500 pages.
Please inform me as to how you would like to proceed.

Sincerely yours,

Geri Holland

Hello Ms. Holland,

Thank you very much for your message and please accept my apologies for the delay in response. Can you please clarify the cost of completing this request? My current understanding of the estimate has it in a cost-prohibitive range.

Best wishes,
Beryl

Dear Beryl:

The Clerk’s Office is currently in possession of about 2,500 pages of
documents that may be responsive to your request. For those documents which
are subject to disclosure, the production costs would be as follows: (1) 20
cents per page for photocopies of a public record; (2) 25 cents per page
for copies of public records maintained on microfilm or microfiche; and (3)
50 cents per page for computer printout copies of public records. These
fees are authorized under the regulations governing access to public
records. *See*, 950 CMR 32.06(1).

At this time we are willing to waive the fee for searching and segregating
the potentially relevant records, which would have required around five
hours of time. The cost of conducting this search would have been $22.17
per hour, based on the hourly rate of the lowest paid employee capable of
performing the task.

Please inform me on how you would like to proceed.

Best,
Geri

Hello Ms. Holland,

Please excuse my tardy response. I believe the fees for reproduction would have been cost prohibitive, but I would like to withdraw this request, as another, similar request is being sent soon.

Thank you for all your help!
