In order to comply with the Federal Driver Privacy Protection Act, the GBPD now requires all requestors to complete the attached records request form to obtain records.

Please be sure to include as much information regarding the records you are requesting including any incident or case numbers you have.

ALSO: You must meet an appropriate authorization under Section III of the attached request form; if you do not, all personal information of anyone other than you will be redacted. Please read through all authorizations and check any that apply to your request; what you check will determine what we can leave in and what we will be required to black out.

All records requests are handled on a first-come, first-served basis; requests can take 7-10 business days to complete. We will contact you by phone at the number you provide on the request form once your request is ready to be picked up.

A fee of 25¢ per page will be collected at the time the completed request is picked up; if the cost is expected to exceed $5, a prepayment will be required.

This letter is to inform the Green Bay Police Department (hereafter “GBPD”) that I am appealing your request to receive a completed “FEDERAL DRIVER PRIVACY PROTECTION ACT PERMISSIBLE USES FORM” prior to processing my records request pursuant to Wisconsin's Open Records Act.

The specific records I have requested are emails sent/received by a GBPD employee to/from an external mailing list which is run by the International Association of Crime Analysts (IACA), a private organization with members in 42 countries, including Canada, Australia, and the United Kingdom.

I have not requested access to any Police Reports, Accident Reports, or any records which should contain personally identifiable information (“PPI”).

If GBPD redacts information included in these emails based on exemptions meant to protect PPI, those redactions would indicate, ipso facto, that a GBPD employee transmitted the PPI of U.S. citizens overseas, perhaps unlawfully, to members of the IACA mailing list, which includes agents of foreign law enforcement and intelligence agencies.

If such redactions are present in responsive documents I receive from GBPD, I will be required to report this ethical—and potentially legal—breach of the public trust to proper authorities, including (but not limited to) the Wisconsin Department of Justice and the Wisconsin Office of the Attorney General.

I have forwarded your request and follow-up email to our Law Department. They have responded that we will not require a DPPA form be filled out; however, personal information and other content may be redacted from the emails pursuant to open records provisions.

Also, we only provide emails in hard copy rather than electronic version. Once I have an estimated number of pages from our IT Department, I will let you know the estimated cost.

It may be the case that multiple GBPD employees received messages from the IACA mailing list. To ease your workload, please feel free to exclude duplicate documents.

For additional note: I have had this request filled by two other U.S. law enforcement agencies already (without any redactions being deemed necessary). If the responsive documents exceed 5,000 emails, and you suspect this will have an significant impact on your department's ability to process public records requests, I would be happy to provide a keyword list to help narrow the number of emails you have to review.

The way your request is written, it appears that you would like us to limit our search of the emails sent/received by Michelle Belongie to only include those sent/received by someone named Armstrong during the time frame of 3/2/16-3/31/16. Please confirm or verify that for us.

Also, are you only looking for emails sent from/received by Michelle Belongie that pertain to IACA or all emails?

Sorry, there was a typo in my first request. The name "Armstrong" should not have been in my letter. It should have said "Arneson."

Michelle Belongie is formally Michelle Arneson.

Another point of confusion: When I received your initial letter yesterday, I thought it was concerning a FOIA request that involved emails sent to/from the IACA mailing list only. That's not the case.

To clarify: Mrs. Belongie sent an email to the IACA mailing list on March 2, 2016, requesting information about the IBM i2 Analyst's Notebook. (" Does anyone know of competitors for I2? Features I like most include social networks, bringing into social media info, phone dumps, timelines.") The specific emails I am looking for are the responses to Mrs. Belongie's inquiry, which was made over the IACA mailing list, but may have been sent to her directly from other law enforcement professionals.

I estimate that Mrs. Belongie would have received these responses, if any, between March 2 and March 31.

Given that I am requesting copies of emails that were not transmitted internationally over the IACA mailing list, my previous letter concerning redactions may no longer be appropriate. Therefore, if your legal team would like me to fill out the Driver's Privacy Act form, I will do so immediately.

Follow up:

To answer your final question, to ensure I receive every response sent to Mrs. Belongie, I requested all of her emails from that time period, since it's unclear if there is a keyword I could offer to help sort out the "i2" related emails from the rest of her work emails.

If it will expedite the process, however, I could probably come up with a keyword list that would be sufficient. If you think that would help, I'll send a list to you today.

If it is alright with you, we will just provide the most recent email that includes all of the conversation rather than multiple copies of the same email.

Also, sometimes the email convo starts up a personal conversation but keeps the same subject line, with multiple to/from emails regarding the personal convo. To save you some money on a heavily redacted email, we will withhold the personal portions of the emails. If you prefer receiving a heavily redacted email instead, just let me know.
