Pursuant to the Texas Public Information Act, I hereby request the following records:

- Recordings made of calls to the 911 number reporting a shooting on January 11, 2016, at around 3:44 pm, at a residence in the 500 Block of Center Oaks Road, outside of Pottsboro, Texas, belonging to Vincent Smith.

- Arrest sheets pertaining to shooter and homeowner Vincent Smith.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

I received your FIOA request today. I have not received this request before today. I am sorry to inform you that the information that you are requesting is part of an ongoing investigation. The Grayson County Sheriff's Office submitted a letter asking the Attorney General's Office for an opinion on a request made for the same information that you are requesting. We received an opinion memorandum back from their office. Both the letter asking for the opinion and the opinion memorandum are attached to this email. Mr. Vincent has not been arrested for any charge in Grayson County.

Thank you for your response, Lieutenant Bigham. I understand that you are withholding the requested information, as the investigation is ongoing.

The memo from the Attorney General's Office indicates, however, that the Sheriff's Office should release the basic information pursuant to section 552.108(c) of the Texas Government Code. Although, as you wrote, Mr. Vincent has not been arrested for any charge in Grayson County, I will now ask that you release any responsive documents covered by section 552.108(c) in the fatal. shooting of Charles Carter.
