Pursuant to the Georgia Open Records Act, I hereby request the following records:

- A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company.

- If the contract(s) was cancelled, any and all materials related to its cancellation.

- If the contract was cancelled, the statement from the university about cancellation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your August 7, 2018 Open Records Request.

As a preliminary matter, the Georgia Open Records Act contains two distinct statutory response times. O.C.G.A. § 50-18-71(b)(1)(A) states that "[a]gencies shall produce for inspection all records responsive to a request within a reasonable amount of time not to exceed three business days of receipt of a request." The Act goes on to state in O.C.G.A. § 50-18-71(d.1) that "[a]ny other provision of the Code section to the contrary notwithstanding, the period within which any production, access, response or notice is required from an agency with respect to a request for records, other than salary information for nonclerical staff, of intercollegiate sports programs of any unit of the University System of Georgia, including athletic departments and related private athletic associations, shall be 90 business days from the date the agency received the request."

Any responsive documents of the University of Georgia Athletic Association are subject to the 90-business-day production time frame set forth in O.C.G.A. § 50-18-71(d.1). A written response will arrive within the time period specified in O.C.G.A. § 50-18-71(d.1).

With respect to your request for "a copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise," we estimate one (1) hour of search and retrieval time to identify any potential records.

As you may be aware, the Georgia Open Records Act provides for charges for search, retrieval, review and production for complying with a request; provided, however, that no charge is made for the first quarter-hour. At $38/hour, minus the first quarter hour, the estimate is $28.50 and will require five (5) business days for production.

Once we receive confirmation of your intent to remit payment in accordance with the estimate provided, we will begin the review of documents in response to your request. (See O.C.G.A. § 50-18-71(d), ..."the agency may defer search and retrieval of the records until the requester agrees to pay the estimated costs unless the requester has stated in his or her request a willingness to pay an amount that exceeds the search and retrieval costs.")

At this point in time we also anticipate that certain records and information within records may be exempt from release in accordance with the exemptions in accordance with O.C.G.A. § 50-18-72(a)(1)(20)(A)(21) and (37). As we process your request, there may additional exemptions. We will notify you of any additional exemptions no later than three business days after the records have been retrieved in accordance with O.C.G.A. § 50-18-71(d).
