Pursuant to the Georgia Open Records Act, I hereby request the following records:

The now concluded investigation of the March 24th shooting death of Nicholas Taft Thomas by Smyrna Police Sgt Kenneth Owens. The Grand Jury issued a "no bill" for indictment in this case on July 9.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

For expediency, it may be sent by email, if permissible to jamiles.lartey@theguardian.com, or faxed to 646.304.5676.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Lartey,

On August 13, 2015, the Georgia Bureau of Investigation received your Open Records request for information on Nicholas Taft Thomas, DOFS (Case Number(s) 2015-1007607, 10-0257-34-15). A search for the requested information was made.

In accordance with O.C.G.A 50-18-70(f) of the Open Records Act, (records available within three (3) business days of receipt of the request), you are hereby notified that all, or a portion, of the requested records are not available for your review at this time. The scientific testing on the case has not been completed. GBI-DOFS expects the reports to be available within a period of 120 days from the date of this letter. At that time you must follow-up with your request if the reports are still needed. The Open Records Unit does not monitor the status of incomplete DOFS cases.

The DOFS (Division of Forensic Sciences) only did a consultation reference to the above. That report has not been completed.

GBI Region 10 (10-0257-34-15) conducted the investigation and they will respond to you separately.

The estimated total cost for administrative expenses incurred in the preparation, copying and mailing of this information is $30.00. This does not include the costs associated with reproducing photographs. No payment is due until you resubmit your request and receive an invoice.
