Good afternoon.

The Georgia Department of Community Health (DCH) acknowledges receipt of your Open Records Act Request #34703 which was received by the Office of General Counsel on February 26, 2018. You have requested "All documentation related to the decision to switch the State Health Benefit Plan prescription benefit provider Express Scripts to CVS Caremark.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes".
Your request is being reviewed to preliminarily determine whether any records may exist that would be responsive. Under the Georgia Open Records Act (GORA) at O.C.G.A. §50-18-71(b)(1)(A), the statute provides that if responsive records exist but are unavailable within three business days, the agency is to provide the requester with a description of such records and a timeline for when the records will be available. At this time, we are determining whether responsive records exist. In the event such records do exist, we anticipate providing you with a timeline to respond to your request by Friday, March 2, 2018 and each week thereafter until such request is fulfilled. Should these records become available sooner they will be reviewed and supplied to you shortly there-after.

Please be advised that the Open Records Act has a provision that allows an agency to charge for the production of records. Pursuant to O.C.G.A. § 50-18-71(d), DCH will provide a cost estimate and obtain your confirmation to pay the charges before finalizing the request if the cost to produce the records is in excess of $25.00.

Please continue to correspond with us via the Open Records Mailbox (openrecordsrequest@dch.ga.gov) so that we may better assist you by keeping all interested parties up to date on this matter.

Thank you for your patience. Please advise if I can be of further assistance.
