Pursuant to the Florida Sunshine Law, I hereby request the following records:

1. the total number of use of force incidents reported by the police department, separated by year and by type of force used from 2013-2014, and 2018-2020 (for example: 15 taser incidents in 2013, 27 taser incidents in 2014, 3 baton incidents in 2013, 18 baton incidents in 2014, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained from 2013-2015, and 2019-2020 separated by year (for example: 8 complaints in 2013, 2 complaints sustained in 2013, 4 complaints in 2014, 1 complaint sustained in 2014, etc.)
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2013-2015, and 2019-2020, separated by year.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2013-2015, and 2019-2020, separated by year.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2013-2015, and 2019-2020, separated by year.
6. a list of all officer involved shootings that were directed at a person from 2013-2020 (excluding shootings of animals and accidental discharges that are not directed at a person).
7. all information reported to the FBI’s National Use-of-Force Data Collection program to date.

If only partial information is available responsive to one or more of these requests, please provide all of the information that is available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a response to your attached public records request. Use of Force (UOF) information is provided in its original format for item #1 with the exception of year 2013 because the tracking of UOF data began the following year. In response to item #5, you are being provided the total number of complaints filed during the periods specified. Additional work (6 hours of reviewing 575 reports @ $20/hourly rate = $120) will be required to determine the cases sustained (item #5), allegations of misconduct (item #2), excessive force (item #3), and biased policing/ racial profiling (items #4) totals. A list of officer involved shootings (OIS) is provided from 2000 to present (2017 being the last OIS incident involving this agency). This agency started monthly submission of information to the FBI's National UOF Data Collection program in 2020 with zero entries reported each time (2 sample reports are attached). It would take approximately another hour to retrieve the remaining submissions for 2020. Thus far, it has taken 4 hours to produce the information provided in this email and it will take an additional 7 hours to fulfill your request entirely. Due to your request requiring extensive labor, we are charging an advance payment of $160 (8 hours of labor at an hourly rate of $20) which must be paid prior to the commencement of any additional work pertaining to items 2 to 7 of your request. Florida Statute 119.07(4)(d) authorizes the imposition of a special service charge when the nature or volume of public records to be inspected is such as to require extensive use of information technology resources, or extensive clerical or supervisory assistance, or both. Your check or money order must be made payable to the "City of Gainesville" and mailed with the attached invoice to the following address: Gainesville Police Department, Attention: Reggie Wilson in Records Division, 545 NW 8th Avenue, Gainesville, FL 32601. Once your advance payment has been received and production of your request is completed, you will be informed of the final costs associated with your request. Hello Sam,

After submission of my last email to you, I later learned that the Use of Force Reports were generated by another department prior to 2014. Therefore, I was able to obtain the 2013 report which is now attached.
