Good morning,

I had a question for you on the attached public records request that you submitted to Fresno County on 10/13/21. I called and left a voicemail for you on this well. The county sent the request to my Office because the DA's Office has a Bureau of Investigations. Did you intend for your request to apply to us as well or was it just for the Fresno County Sheriff's Office? My direct line is 559-600-2113, or feel free to email me. Thank you.

From: John Lindsay-Poland

Dear Public Records Unit staff of Fresno County Sheriff's Office,

I have received your reactivation letter dated December 20, 2022, in response to my Public Records Act request submitted in October 2021. My request was for purchase and deployment records for certain types of equipment used by FCSO, including less lethal launchers and chemical agents. Your letter states that a letter was sent to me on December 20, 2021, requesting case numbers and/or dates of incidents pertaining to my request. I did not receive such a letter. On the other hand, my colleague Jennifer Tu wrote to your agency on December 2, December 6, and December 20, 2021 requesting updates on the status of responding to my request.

My request for deployment records, by its nature, is for records for which I do not know the dates or case numbers. Instead, it refers to records of deployments by FCSO since Jan. 1, 2020 of certain types of equipment: projectile launch platforms, such as 40mm projectile launchers, "bean bag" or specialty impact munition ("SIM") weapons, and "riot guns" used to disperse chemical agents; explosives and pyrotechnics, such as "flashbang" grenades and explosive breaching tools; and chemical weapons such as "teargas" and "pepper balls".

The request was also for purchase records since 2015 of patrol rifles, less lethal launchers, armored vehicles and LRADs, and since 2018 of flashbang devices and chemical agents. See the original request for more details.

Finally, I would like to add that we submitted an identical request in October 2021 to more than 150 law enforcement agencies in California. Nearly all have already responded and disclosed records. I appreciated you continued attention to this request.

Sincerely,
John Lindsay-Poland
