Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I would like all records pertaining to a report made by Harry Plausse, Franklin PD, regarding the shoe left by Theresa Corley on December 6,7, 8 or 10th of December 1978 when he responded to a disturbance call at the Presidential Arms in Franklin. I have been told in previous requests that Franklin does not have any information regarding the case that took place in their town, but as of September 5th 2015, I have an email from Chief Semerjian that there is still a log book from 1978. In addition, I would like the dates of any interviews conducted by Tom Curran regarding this case that include the Steve Frechette, John Kelly, David Cohn, Ronald Moore. Just the dates of interviews, no specific details regarding the interviews needed.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon Geraldine,
I am attaching the log from 1978 for the calls that you referenced.
Discussions that were had at the destination of those calls are not part of
the daily log. If any reports were filed that referenced Theresa Corley's
shoe they would be part of the file that is held at the state police
records division as part of the unsolved case. We do not have any reports
pertaining to that incident. Bellingham PD and the State Police were in
charge of the investigation and if we assisted and interviewed persons;
John Kelly, David Cohn, Ronald Moore and Steven Frechette those interviews
would be a part of their case file. Interviews pertaining to a case are
not a "call for service" and are not their own separate entry in the daily
log and therefore we do not hold the record of date or time and if they
were conducted. Any interviews that are conducted by our detective
division are added to the case file of relevance. Please see attached of
the available logs for service from and around those dates at Presidential
Arms and reference to Theresa's disappearance.

I got information from Harry Plausse that he specifically went to the Presidential Arms and he spotted a shoe. The people in the apartment told him it was "Terry's, she must have left it behind" Why would there be no log entries that Plausse responded to a call at the Presidential Arms? He told me he went there due to a domestic disturbance. As much as Franklin PD seems to believe this murder did not initiate in their town, it did. I was also told by Richard Cogliano that he went to his Uncle a Franklin PD detective because he had overheard where Theresa was taken. So why wouldn't that uncle make any note of that encounter?

Hi Geraldine,
Any and all records pertaining to an unsolved murder case would be part of
the original case file. This case file is part of the state police and
DA's office file. We do not hold any records of this case at Franklin PD;
it was not our investigation. The discovery of the shoe at presidential
arms is documented in the case file. With the information that you
provided; I sent the two responses for noise disturbance to you in my last
email. Only the primary officer is listed; and it is probable that Officer
Plausse assisted them at one of those two calls where Theresa's shoe was
discovered. Public Record Law does not require us to save details of the
call log beyond one year. If a report is generated from any call or
response; that report becomes part of the case file and would follow the MA
Public Record Law Retention Schedule. Any statements made to a detective
would be the responsibility of the detective to add it to the open case
file maintained at the state police. We would not have a log of an alleged
conversation. We realize the emotion brought forward by the case being
unsolved; and Franklin PD has provided you all call records from 1978 that
were within the time frame that you provided.
