Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Seeking a certified copy of the following public records for an allegedly existing person named "S. Yoder" who allegedly held the position of "Hearing Officer, Bureau of Administrative Review" in Nov 2000 at the Ft Myers, FL location at that time of "6350 Presidential Court #C, Ft Myers, FL 33919" --

(1) A job application and resume for "S. Yoder" or "S.L. Yoder" filed with FL HSMV

(2) A FL HSMV Personnel Action form showing date and reason for separation of employment for "S. Yoder" or "S.L. Yoder"

(3) A salary history for "S. Yoder" or "S.L. Yoder" while allegedly employed at FL HSMV

Although not required to do so, I am stating herein my reasons for making this public records request:

The names "S. Yoder" and "S.L. Yoder" appear in what I believe to be sham documents filed in a sham proceeding, and I am not sure if this person even exists.

I have never been notified of any FL HSMV hearing(s) by anyone.

I have never attended any FL HSMV formal administrative review. Yet: according to certain court records currently online at the Collier County Court -- which I have only recently been able to obtain and inspect, someone named "S. Yoder" in Nov 2000 is making false claims. Specifically:

(a) According to documents signed by "S. Yoder" apparently "S. Yoder" of FL HSMV claims to have received from me a communication from me to the FL HSMV, instructing FL HSMV to send me notices at a Naples law firm address of Naples attorney Donald Day -- when in fact I have not ever given nor communicated any such address for myself to FL HSMV. Again, I have never authorized FL HSMV to send me any notices at any law firm address; and I have never used a law firm address or given any law firm address to any police officer. And:

(b) According to documents signed by "S. Yoder" apparently "S. Yoder" thinks it is OK to conduct not one, but two formal administrative review hearings without me being present when in fact that is a violation of FL statute. And I would think conducting administrative reviews without the subject driver present is something that would be known to be illegal by a "Hearing Officer." (I was also never provided any notice of any such hearings, and that, too, is also a violation of FL statute and my constitutional rights to due process.)

I do not believe any such hearings took place, as I have no knowledge of such; and, due to the gross violations of FL Statute (of FL HSMV allegedly conducting two hearings about a driver (me) without the driver present, in violation of FL Statute), and FL MSMV using a law firm address as my address (when I have never communicated or provided any such law firm address to FL HSMV or any police officer), I am thus having a very hard time believing any employee named "S. Yoder' actually ever existed at FL HSMV.

I read the Responsive Documents. She seems to be a high school graduate and that's it. Is that correct, that no other education is required for one to conduct hearings for the state?

My other question is how did she, "S. Yoder," who apparently exists at least on paper, conduct a hearing without me present -- and without notifying me -- in violation of as FL law??

I would like to know how often this happens:
that hearings are conducted, or paperwork alleging a hearing took place is fabricated, as I never attended any hearing and was never notified.

There were NO CHARGES FILED after I was falsely arrested, so how do I contact those in charge of hearings, to find out what is in the hearing file? A hearing file which I never heard of!

I see you wrote "respectfully" but in all honesty, your agency conducting hearings without the person present, and without notifying the person, in violation of FL law, and resulting in a stack of what looks to me to be forgeries now at this court site,
is hardly respectful.

If you can provide any answers I would appreciate it. I will follow up with another public records requests for the hearing file, if you can tell me how long these files exist and if these are considered public records.
