Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Seeking a copy of the document(s) or paragraph(s) or page(s) of procedures used by your agency in Florida, which explains the answers to the following two questions:

1) What agency is the origin of information received by your department about drivers arrested for DUI? (Does your procedure require you to obtain / receive information from the court, the local police, or the state attorney -- and how is this information about a DUI arrest initially transmitted to your agency?)

2) Does your department then sell or provide names and addresses of drivers arrested for DUI (and facing a license suspension) to DUI lawyers seeking potential clients? (Where are FL DUI lawyers getting a driver's name and address to solicit the driver's business? From your agency, the court, the police, or the state attorney?)

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Florida Clerk of Courts send dispositions to the Department of Highway Safety and Motor Vehicles and the driver records are updated if applicable.
2) Does your department then sell or provide names and addresses of drivers arrested for DUI (and facing a license suspension) to DUI lawyers seeking potential clients? (Where are FL DUI lawyers getting a driver's name and address to solicit the driver's business? From your agency, the court, the police, or the state attorney?) No, The Department of Highway Safety and Motor Vehicles does not provide this information.
