Re: Donald Day's Fraud 2-pg doc - and FL AG Pam Bondi, and US DOJ

Susan A. filed this request with the Office of the Attorney General - Florida of Florida.
Status

Communications

From: Susan A.

To Whom It May Concern at the FL AG Office:

Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Seeking a certified copy of any and all correspondence and documents your office received from the US DOJ, which I had provided to the US DOJ, as according to their letter to me dated July 2012, they sent such documents to your office in or around July 2012. I then received the attached letter dated Sept 19, 2012 from FL AG Pam Bondi's Office in response.

Note, I still believe: it is actually impossible for any private attorney, including Naples DUI Attorney Donald Day, to legally seek and obtain an "expungment" from the FL Dept of Law Enforcement, when said attorney has never actually been to criminal court on a matter. And that matter has never actually been in the criminal court system.

However, it appears to me that in Florida, it is actually quite easy for a corrupt attorney to go apply to for an expungement of a criminal matter from the FL Dept of Law Enforcement -- and, under the guise of seeking an "expungment" -- fraudulently obtain an expungement, by using a fake criminal court document (a piece of fraud) for the actual purpose of: destroying all the evidence of corruption of public officials in a criminal matter (such as the false arrest of a law-abiding citizen such as myself, because that citizen is a witness to public corruption).

If the law-abiding citizen should happen to prove, as I did, that there is no DUI, because I went to a lab and took a urine test after being released from jail, and I was clean, as I knew I would be, then, there is no case to prosecute falsely based on the intended fraudulent and false "eye witness testimony" from a corrupt expert police officer/dectective. So, the corrupt public officials must hurry up and expunge everything -- all the bogus evidence must be destroyed!

And, apparently, any fraudulent criminal court document created by a corrupt private DUI attorney will suffice for any real criminal court document actually required by the FL Dept of Law Enforcement prior to that department approving an expungement.

Destroying evidence of public official corruption is the actual reason for the "expungement" -- since the matter was actually never in the criminal court system and is therefore not eligible for expungement.

The requested public record documents from the FL AG office will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available and by CD Rom if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Sincerely,

Susan Alyn

Re: MR#19495-160245 – Freedom on Information Request re: Donald Day

Dear Ms. Alyn:

This will respond to your July 7, 2015 fax in which, pursuant to Ch. 119,
F.S., you make the following request for public records:

“a certified copy of any and all correspondence and documents your
office received from the US DOJ, which I had provided to the US DOJ,
as according to their letter to me on July, 2012, they sent such
documents to your office in or around July, 2013.”

A search of our Correspondence database has produced one record that may be
responsive to your request. Please find that record attached. This office
does not provide any certification of our records. We are able to state
that the attached is a copy of a record on file in the Office of the
Attorney General. Should you have any questions or concerns, please do not
hesitate to contact our office at 850-245-0140.

Re: MR#19495-160245 – Freedom on Information Request re: Donald Day

Dear Ms. Alyn:

This will further respond to your July 7, 2015 fax in which, pursuant to
Ch. 119, F.S., you make the following request for public records:

“a certified copy of any and all correspondence and documents your
office received from the US DOJ, which I had provided to the US DOJ,
as according to their letter to me on July, 2012, they sent such
documents to your office in or around July, 2013.”

A fax from you via MuckRock News, received by the Office of the Attorney
General on July 22, 2015, indicated you wish to follow up on your original
request submitted on July 7, 2015. This office replied to your request on
July 15, 2015 with the public records we were able to locate responsive to
your request, a copy of which was attached to your most recent fax. It is
therefore unclear what additional information you are requesting. A search
of our Correspondence database using the keywords “Susan Alyn” does not
return any other records responsive to your request. In the event that you
did not receive the records, I am sending the attachment again, Should you
have any questions or concerns, please do not hesitate to contact our
office at 850-245-0140.

From: Susan A.

To Leslie Jacobs, Public Records Coordinator, Office of the [FL] Attorney General:

I briefly looked over the response you sent and did not yet have a chance to check word for word.

However, on first glance, it seems to me your office has actually not produced nor provided to me the actual
records I originally sent to the US Dept of Justice Attorney.

The actual records included: a 2-page piece of fraud created by a FL DUI attorney, Donald Day. I do not see that
piece of fraud in the response you have given me to my public records request.

When I sent that 2-page piece of fraud to the US DOJ, and learned the Miami US DOJ then forwarded it to your office,
I knew nothing lawful would come of my efforts because: neither the Democrat Miami US DOJ nor your GOP AG Office
recognized Donald Day's fraud as fraud. It may have been an unintentional mistake on the part of the US DOJ office,
as they may not be familiar with local laws concerning local court procedures, but I am sure your office was aware that
this 2-page piece of fraud from Donald Day was: fraud.

Yet, your office ignored that fraud. Now, your office claims: it does not have that 2-page piece of fraud in its possession.

I will write to the Democratic Miami US DOJ attorney asking him if he can provide me with what he sent to your office,
and then check the two responses to my public records request (yours and his).

I distinctly recall being extremely disappointed this US DOJ attorney forwarded anything to your office, because I knew that
would do nothing to help me.

And, I was correct.

So, while you have "completed" your response to my request, I am reserving judgment on whether you have actually complied,
It seems to me on first glance you are concealing actual public records that perhaps the US DOJ did mail to you, which I know I
did provide to the US DOJ.

After all the work of writing and sending these records - the 2 pages of fraud by DUI Attorney Donald Day, which I did not know at the time exactly how to describe the fraud -- I realize: I wasted my time by contacting the US DOJ in Miami and he wasted his time by contacting you. Because neither of your offices identified that 2-page document correctly, as a piece of fraud.

Thus, again, not meaning to sound rude or anything, but, I am not at all of the opinion that your office has actually responded to my public records request here, even though the official status is "completed."

I will check to see what the US DOJ wants to claim they sent to your office, and then I will re-check my files.

I am hoping the US DOJ office will agree with me that I sent to the US DOJ that 2-page piece of fraud by DUI Attorney Donald Day,
and this is what the US DOJ did send to your office -- which is now missing/omitted/deleted from your public record files, apparently.

From: Susan A.

PS Ms. Jacobs --

Re your written statement: "This office does not provide any certification of our records."

Could you please email here the written law or written agency policy of the Florida Attorney General concerning public records procedures, and include that part which exempts the Attorney General from certifying a public record? I am not able to find any such exemption in the Florida Sunshine law. Thank you.

From: Susan A.

To Lisa Jacobs, FL Attorney General Office: Re your statement to me: "This office does not provide any certification of our records." Please see the law
below:

s. 119.07(4), F.S.,
requires the custodian to "furnish a copy or a certified copy of the record...”

This is in the 2015 law --

http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199/0119/Sections/0119.07.html

(4) The custodian of public records shall furnish a copy or a certified copy of the record upon payment of the fee prescribed by law.
-----------

Since the FL Statute requires your office to provide a "copy or certified copy" and since I requested a "certified" copy -- as I am allowed to do by current FL Statute -- your office has to provide me with a "CERTIFIED COPY" as per the existing law of the State of FLorida, which I would think someone at the attorney general's office should know, especially since the FL AG is the entity required to write opinions about Sunshine Law.

As I have now cited to you the exact FL statute and the link where you can find this 2015 law, please do not delay in certifying for me what your office wants to claim the US DOJ sent to you.

After you certify the public records -- as you are in fact required to do by law when someone requests certification, and I did -- and then send to me the certified copies, I will then take a closer look.

Right now it does not appear to me your office has complied with my actual public records request to your office.

Thank you.

Susan Alyn

From: Susan A.

Also please tell me the fee for certified copies, so I can pay the cost of these certified copies.

Thank you. By the way, it is extremely disturbing to me that I am dealing here with an office of an attorney general who is clearly
telling lies to you and to me, that your office does not certify copies, when your office does, and the law says you do. Extremely disturbing to me.

including Naples DUI Attorney Donald Day, to legally seek and obtain an
"expungment" from the FL Dept of Law Enforcement, when said attorney has
never actually been to criminal court on a matter. And that matter has
never actually been in the criminal court system.

However, it appears to me that in Florida, it is actually quite easy for a
corrupt attorney to go apply to for an expungement of a criminal matter
from the FL Dept of Law Enforcement -- and, under the guise of seeking an
"expungment" -- fraudulently obtain an expungement, by using a fake
criminal court document (a piece of fraud) for the actual purpose of:
destroying all the evidence of corruption of public officials in a criminal
matter (such as the false arrest of a law-abiding citizen such as myself,
because that citizen is a witness to public corruption).

If the law-abiding citizen should happen to prove, as I did, that there is
no DUI, because I went to a lab and took a urine test after being released
from jail, and I was clean, as I knew I would be, then, there is no case to
prosecute falsely based on the intended fraudulent and false "eye witness
testimony" from a corrupt expert police officer/dectective. So, the corrupt
public officials must hurry up and expunge everything -- all the bogus
evidence must be destroyed!

And, apparently, any fraudulent criminal court document created by a
corrupt private DUI attorney will suffice for any real criminal court
document actually required by the FL Dept of Law Enforcement prior to that
department approving an expungement.

Destroying evidence of public official corruption is the actual reason for
the "expungement" -- since the matter was actually never in the criminal
court system and is therefore not eligible for expungement.

The requested public record documents from the FL AG office will be made
available to the general public, and this request is not being made for
commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would
inform me of the total charges in advance of fulfilling my request. I would
prefer the request filled electronically, by e-mail attachment if available
and by CD Rom if not.

Thank you in advance for your anticipated cooperation in this matter. I
would request your response within ten (10) business days.

Sincerely,

Susan Alyn
