Pursuant to the Florida Sunshine Law, I hereby request the following records:

Please provide copies of all documents, recordings, video and all other relevant materials discoverable under the Florida Rules of Criminal and Civil Procedures related to the commission and report of forgery and official misconduct related to the filing of a forged court order on or about 6/30/2017 in Lee County Court, 17-mm-815, State v. Huminski. The Court order was manufactured from a valid and legitimate court order filed in the 20th Circuit Court, 17-CA-421, Huminski v. Town of Gilbert, et al. filed on 6/5/2017 in the Circuit Court. Both the original Circuit Court order and the forgery of 3 weeks later are contempt show cause orders.

Please produce the same materials for accessories after the fact regarding the forgery and official misconduct such as judicial officers, law enforcement personnel or prosecutors who furthered or covered-up these crimes.

Attached hereto are a court brief filed in the Supreme Court of Florida detailing the forgery and also a court paper filed in the Florida Second District Court of Appeal detailing the forgery and official misconduct.

The forged document was manufactured by lifting the judicial signature and most of the content from the Circuit Court order of 6/5/2017, then the lifted content was hand-modified by a court employee and then provided to the Clerk of Courts for filing as an original and legitimate court order authored by a judge for filing in a new case initiated with the forgery, 17-mm-815, but, without a new valid signature from a judge on the manufactured paper -- just the lifted judicial signature of 6/5/2017 existed. It was held out and presented to the clerk of courts for filing as authentic. Serious official crime.

Subject: Report of Felony Forgery to Carmine Marceno & State's Attorney Amira Fox, Lee County, 17-mm-815, Show cause order filed on 6/30/2017

Carmine Marceno, Amira Fox, Esq.,

The Lee court staff engaged in forgery of a County Court Order on or about 6/30/2017 to which Amira Fox and her office were accessories to before and/or after the fact.

This forgery was accomplished by lifting the judicial signature off a valid Circuit Court order of 6/5/2017, 17-ca-421, and using the lifted signature to manufacture an order designed to initiate a County Court criminal proceeding without a valid signature from a judge, prosecutor or any valid official. All of this activity was behind closed doors and designed to thwart attempts to identify the forger. It is likely that the forgery was coordinated by Judge Krier and/or Judge James Adams.

Sheriff Carmine Marceno is well aware of these courthouse crimes and is covering them up to benefit his close ally S.A. Amira Fox.

The crime of Forgery is a Third Degree Felony in Florida and is punishable by up to five (5) years in prison, five (5) years of probation, and a $5,000 fine. F.S. 831.01 Forgery is assigned a Level 1 offense severity ranking under Florida's Criminal Punishment Code.

The Statutes involved in these crimes including the statute of limitations are as follows:

838.022 Official misconduct.—
(1) It is unlawful for a public servant or public contractor, to knowingly and intentionally obtain a benefit for any person or to cause unlawful harm to another, by:
(a) Falsifying, or causing another person to falsify, any official record or official document;
(b) Concealing, covering up, destroying, mutilating, or altering any official record or official document, except as authorized by law or contract, or causing another person to perform such an act; or
(c) Obstructing, delaying, or preventing the communication of information relating to the commission of a felony that directly involves or affects the government entity served by the public servant or public contractor.
(2) For the purposes of this section:
(a) The term “public servant” does not include a candidate who does not otherwise qualify as a public servant.
(b) An official record or official document includes only public records.
(3) Any person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

831.01 Forgery.—Whoever falsely makes, alters, forges or counterfeits a public record, or a certificate, return or attestation of any clerk or register of a court, public register, notary public, town clerk or any public officer, in relation to a matter wherein such certificate, return or attestation may be received as a legal proof; or a charter, deed, will, testament, bond, or writing obligatory, letter of attorney, policy of insurance, bill of lading, bill of exchange or promissory note, or an order, acquittance, or discharge for money or other property, or an acceptance of a bill of exchange or promissory note for the payment of money, or any receipt for money, goods or other property, or any passage ticket, pass or other evidence of transportation issued by a common carrier, with intent to injure or defraud any person, shall be guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Statute of limitations for public officer/employees,
775.15 Time limitations; general time limitations; exceptions.—
(12) If the period prescribed in subsection (2), subsection (8), subsection (9), subsection (10), or subsection (11) has expired, a prosecution may nevertheless be commenced for:
(a) Any offense, a material element of which is either fraud or a breach of fiduciary obligation, within 1 year after discovery of the offense by an aggrieved party or by a person who has a legal duty to represent an aggrieved party and who is himself or herself not a party to the offense, but in no case shall this provision extend the period of limitation otherwise applicable by more than 3 years.
(b) Any offense based upon misconduct in office by a public officer or employee at any time when the defendant is in public office or employment, within 2 years from the time he or she leaves public office or employment, or during any time permitted by any other part of this section, whichever time is greater.

777.03 Accessory after the fact.—
(1)(a) Any person not standing in the relation of husband or wife, parent or grandparent, child or grandchild, brother or sister, by consanguinity or affinity to the offender, who maintains or assists the principal or an accessory before the fact, or gives the offender any other aid, knowing that the offender had committed a crime and such crime was a third degree felony, or had been an accessory thereto before the fact, with the intent that the offender avoids or escapes detection, arrest, trial, or punishment, is an accessory after the fact.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
