Pursuant to the Florida Sunshine Law, I hereby request the following records:

The calendars of Senators Loranne Ausley, Jim Boyd, Jennifer Bradley, Jason Brodeur, Danny Burgess, Ileana Garcia, Shevrin Jones, Tina Polsky, Ray Rodrigues, and Ana Maria Rodriguez, Ben Albritton, Jeff Brandes, Audrey Gibson, Kelli Stargel, and Wilton Simpson, both in Tallahassee and in their respective districts, from May 1st, 2021 to the present.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

A response to this request will be given in a reasonable amount of time. Should this request result in an extensive use of Senate information technology resources, clerical or supervisory assistance, an extensive use fee estimate will be provided for approval prior to processing the request.

The Senate provides this response pursuant to Article 1, Section 24 of the Florida Constitution, section 11.0431, Florida Statutes, and Senate Rule 1.48. Under Article 1, Section 24(c) of the Florida Constitution, each house of the Legislature is exclusively authorized to adopt rules governing the enforcement of the maintenance, control and disposition of public records with respect to their own public records.

The Senate will be in contact should any additional information be needed. Otherwise, a notification will be sent once the records are ready for release.

The Senate has been working to collect records to fulfill your public records request, dated January 5, 2022, for the following information:

* "The calendars of Senators Loranne Ausley, Jim Boyd, Jennifer Bradley, Jason Brodeur, Danny Burgess, Ileana Garcia, Shevrin Jones, Tina Polsky, Ray Rodrigues, and Ana Maria Rodriguez, Ben Albritton, Jeff Brandes, Audrey Gibson, Kelli Stargel, and Wilton Simpson, both in Tallahassee and in their respective districts, from May 1st, 2021 to the present."
The search has generated 5,942 email results from Senate IT. Some public records requests are able to be fulfilled without a charge; however, a reasonable fee to recover the cost of production may be imposed when a public records request requires an extensive use of Senate resources to compile and produce the records. "Extensive use" is any public records request that requires more than two hours of Senate resources to review, process and/or redact confidential or exempt information. Voluminous records will be provided in an electronic format. Additional charges may apply where hardcopies of voluminous records are requested.

Attached, is the Extensive Use Fee Estimate Invoice for this public records request which is approximately $1,420.45. Please note that this is an estimate only and the cost involved could be more or less depending on the actual number of hours of worked and/or resources used to comply with this request.

We require a payment equaling 75% of the estimated cost prior to proceeding with processing the records. The remaining 25% is due prior to the release of the records. Funds received in excess of actual costs will be refunded to the requester.

Please advise how you would like to proceed with this request.

Michelle,

Thanks for sending this. I see that the extensive use fee includes thousands of emails. The request was only for the calendars. A screenshot of each calendar with enough information to actually read the schedules would be sufficient. At one point, the Senate President's calendar was published on flsenate.gov. Can you re-evaluate the request and let us know? This extensive use fee sounds pretty exorbitant.

Yes, the Senate President's calendar is still published weekly on our website https://www.flsenate.gov/PublishedContent/Reference/PublicRecords/Links/1.19.22%20WES%20Schedule.pdf We can gather the previous weeks for your request.

Not including the President's calendars, we had to conduct an IT search to gain access to the other Senators calendars.

This produced the amount of items retrieved that I mentioned in my previous email. This includes both district and Tallahassee calendars.

I realize it does seem like a large amount but we have to check each individual entry to make sure no information is confidential or exempt.

We will be more than happy to work with you to get you the information you need.

Please let me know how if you want to narrow the request and how you would like to proceed.

We don't need to be able to search through the individual entries. The document with the President's schedule is reflective of what we are asking for. A PDF printout that just has the headings is fine.
