Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Information related to FDC's "Use of Force Reduction Efforts 2015"(https://d3gn0r3afghep.cloudfront.net/foia_files/2015/09/28/UOF_Reduction_Efforts_2015_4rWtRSl.pdf), as noted on page 3:

"We have a Use of Force Advisory System managed by the Office of Inspector General to track and notify each Warden of a staff member who has been involved in 8 uses of force incidents within an 18 month period."

"In November 2014, modifications were made to the Use of Force Advisory System. Any staff using force more than 8 times in 18 months is reviewed by the respective Warden for continued duty assignment or possible reassignment to another post. The Warden completes the review, documents the findings and actions, and forwards to the respective Regional Director for final review."

I am specifically requesting the following information:

• The number of staff identified by this system as using force more than 8 times in 18 months (since November 2014)
• The institution(s) where those staff members used force more than 8 times in 18 months
• The findings and action of the review(s), as documented by the Wardens and forwarded to the respective Regional Directors (i.e., continued duty, reassignment, etc.)
• The outcome(s) of the Regional Director's final review

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Can you tell me whether records exist for the first item in my request:

• The number of staff identified by this system as using force more than 8 times in 18 months (since November 2014)

Or would records have to be created to fulfill that specific request?

If records do exist for this item, can I amend my request and limit it to only this specific item?

And if records do not exist for this item, is that because no officers have been identified at this time as using force more than 8 times in 18 months? Or is that because the modified Advisory System doesn't allow for reporting this information?

Re: PRR#15-0932 - FDC'S USE OF FORCE REDUCTION REPORTS

Thanks for the quick response.

It's my understanding that the Reduction Efforts referenced in my request were included in a directive issued by Deputy Secretary Ricky Dixon, as noted in the Miami Herald in November 2015 (http://www.miamiherald.com/latest-news/article42744786.html):

“To continue in this trend, and to ensure that our agency maintains use-of-force policies that are in line with national best practices, Deputy Secretary Ricky Dixon recently issued a directive regarding the implementation of new and revised use-of-force policies.” - McKinley Lewis

This directive was also noted in a presentation by Stacy Arias, Chief of Staff, Florida Department of Corrections (http://youtu.be/yoDPDqRFcu8).

Can I amend my request and ask for a copy of this directive? I haven't been able to find a copy online, only references similar to those above. I'm just trying to understand how these Reduction Efforts are being implemented and get a sense of their effect.

To clarify my request, I am referring to the section of the Ricky Dixon directive under the heading Office of Inspector General Notifications:

"Effective this date, the warden will now be notified of any officer(s) involved in three or more reactionary use of force incidents in a six month period... Additional information regarding documentation will be forthcoming."

I am requesting copies of the documents/directives issued after October 23, 2015 regarding documentation related to the notification of wardens following an officer's third (or subsequent) use of force incident.

Additionally, I am requesting copies of all notifications sent to wardens between October 24, 2015 and June 16, 2016 regarding officer's third (or subsequent) reactionary use of force incidents.

Please let me know if further clarification is needed.

Please see responses below from Tammy Graham and Walt Edwards, Office of Inspector General, in response to your amended request for “notifications sent to wardens regarding officers using force more than 8 times in 18 months, since November 1, 2014?” As stated in a previous email to you dated June 21, 2016, Tammy Graham of the Office of Inspector General advises that they do not have a program that is able to provide this information as you have requested. Both Ms. Graham and Mr. Edwards have suggested that we forward your request as stated above to the Office of Information Technology for an email search. However, this may be a difficult task, since the wardens move from institution to institution and it would difficult attempting to retrieve the specific emails sent to specific wardens as you have requested below.

Please review this email, however, please also keep in mind that the Office of Information Technology processes email search requests in the order in which they are received. The number of pending requests, the complexity of search criteria and parameters and the date range contribute to the response time. Upon completion of your email search, you will be provided with a cost estimate for production of the returned emails. Subsequent to receipt of payment and the records being reviewed for any confidential information which may or may not be contained within the emails, the records will be produced in accordance with s. 945.10 and Chapter 119, Florida Statutes.

Thanks for the reply and my apologies for the continued back and forth. Can you help me better understand the process involved in the use of force notification system? Because my understanding is based on the language in the Use of Force Reduction Efforts document:

"Track and notify each warden of a staff member who has been involved in 3 reactionary uses of force incidents within a 6 month period. "

I gather from your response that the notifications are sent to wardens via email. It's the tracking piece that I'm unclear on. My assumption is that tracking is for reporting purposes, so for example, that IOG will be able to report "X number of staff has been involved in 3 incidents within a 6month period". Am I wrong in this assumption? Because that's the information I'm trying get: the number of staff involved in 3 or more incidents within a 6 month period within each facility.

Any insight is greatly appreciated!

Please note that the statutory obligation of the custodian of public records is to provide access, to or copies of, public records “at any reasonable time, under reasonable conditions, and under supervision by the custodian of public records” provided that the required fees are paid. §119.07(1)(a) and (4), Florida Statutes. However, a custodian is not required to give out information from the records of his or her office. (AGO 80-57).

Hi Mrs. Houpt,

In the Use of Force Assessment conducted by ASCA, on page 41, it states:

"The ASCA Review Team noted that 107 correctional officers at the Suwannee Correctional Institution and 110 correctional officers at the Union Correctional Institution met the threshold of having participated in eight or more uses of force in the last eighteen months."

Clearly, FDC provided the review team with records that allowed them to discern this information. This is the exact information I am trying to obtain.

The assessment also details, under the list of Documents Reviewed (Appendix A, p. 71) several excel spreadsheets related to use of force, including:

2015-04-30 assault and uof data.xlsx
2015-05-22 UOF Incidents 11-2013 - 04-2015 by facility.xlsx

I assume this information is similar to the spreadsheets available on the FDC website here http://www.dc.state.fl.us/pub/record/index.html.

These were also provided in response to a request for information here https://www.muckrock.com/foi/florida-34/fl-doc-use-of-force-reports-2000-2014-16050.

The difference between these spreadsheets and the information I'm requesting (and what the ASCA review team presumably had access to) is the inclusion of some type of anonymized identifier for the officers involved.

The dates I'm requesting this for are October 24, 2015 to August 1, 2016.

Is there any way I can amend my request and ask for this information? Or do I need to file a new request altogether?

Thanks again for all your help with this request. After speaking with Tammy Graham on the phone and reading through the internal correspondence you forwarded, I'd like to amend this request.

On October 23, 2015 Deputy Secretary Ricky D. Dixon issued a directive to all wardens revising the Use of Force Notification provision, stating, in part:

"Effective this date [October 23, 2015], the warden will be notified of any officer(s) involved in three or more reactionary use of force incidents in a six month period."

I am requesting copies of all notifications sent to wardens under this provision from October 24, 2015 to September 20, 2016.

I understand, based on our previous correspondence, that this is a potentially complicated and time consuming request.

I also understand, according to Walt Edwards' email dated June 23, 2016, this should be directed to the "server team" within the Office of Information Technology.

I don't know if there's a specific subject line that these email notifications contain, but presumably there's something that identifies these emails as use of force notifications. If so, please include this in the search criteria.

Please be advised that Tammy Graham contacted Walt Edwards who advised that your amended request will be forwarded to the Office of Information Technology for an email search. Approximately 1,136 emails have been retrieved. If you would like to proceed with the email production, the emails will need to be reviewed for possible exemptions of confidential information and then copied to a CD. Below is a cost estimate for staff time and the cost of a CD:

1,136 emails x 2 minutes average review time per email = 2,272 minutes
2,272 minutes divided by 60 = 37.87 hours
37.87 hours x $13.47 per hour for review = $510.11
One CD at $1.13 each = 1.13
Total amount due: $511.24
