Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Documents relating to any agreements, contracts or instances where the Department loaned out a cell site simulator (including StingRay, AmberJack, Hailstorm, Kingfish, Gossamer, Triggerfish, or DRTboxes) to another law enforcement department. This includes:
-emails
-memos
-written requests
-invoices
-contracts or other agreements
-any documentation on specific instances where a cell site simulator was loaned out

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is to confirm receipt of your request identified as FDLE PRR 2016-3542 which was received via email by our office on December 9, 2016 and regarding “…Documents relating to any agreements, contracts or instances where the Department loaned out a cell site simulator (including StingRay, AmberJack, Hailstorm, Kingfish, Gossamer, Triggerfish, or DRTboxes) to another law enforcement department. This includes: -emails -memos -written requests -invoices -contracts or other agreements -any documentation on specific instances where a cell site simulator was loaned out…”

Public records requests are processed individually and in the order received. On January 20, 2017, the FDLE Office of the General Counsel emailed you an invoice for $43.64 for your PRR 2016-3195 public records request, which was concerning any and all documents/records pertaining to ISMI catchers and was originally received by our office on 10/31/16.

Upon receipt of the outstanding funds for PRR 2016-3195 those records will be emailed to you. At this time our office considers your request PRR 2016-3542 to be closed pending the receipt of your outstanding balance due. You may choose to re-request it at the time you submit your payment for $43.64 or make any new requests. All balances for outstanding public records requests must be paid in full before we will process new or additional records requests.

An agency may refuse to produce additional records if the fees for a previous request for records have not been paid by the requestor. See Lozman v. City of Riviera Beach, 995 so. 2d 1027(Fla. 4th DCA 2008) (s. 119.07[4], F.S., “does not require the City to do any more than what it did in this case,” i.e., require Lozman to pay the bill for the first group of records he requested before the city would make any further documents available).

Attached is a copy of the email we sent with the invoice information for PRR 2016-3195. Also, we have attached a copy of our FDLE Guide to Public Records for your reference.
