To Whom It May Concern:
Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:
This is a request under the Freedom of Information Act. I hereby request the following records:
Three 911 calls from a Canfield Green Apartment resident on August 26 between 3:22am and 4:19am reporting people banging on his door, shooting outside his window/door.
Please limit my request, if possible, to records that have been previously processed under the provisions of the Freedom of Information Act.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.
Due to the scope of the request, we will be unable to produce the information within three business days. Your request includes documents or records that are kept in other departments of the City and, therefore, additional time will be needed to research those documents and records.
Once assembled, you will be informed of the estimated costs associated with retrieval and copying of the records.
The City has received your request.
Please note that all 9-1-1 calls and recordings are to be kept confidential and closed under Section 610.150 RSMo absent a court order and the circumstances addressed in the statute.
Therefore, the City cannot release any 9-1-1 calls and recordings at this time.
It is understood that: "610.150. Except as provided by this section, any information acquired by a law enforcement agency or a first responder agency by way of a complaint or report of a crime made by telephone contact using the emergency number, "911", shall be inaccessible to the GENERAL PUBLIC"
However I am not a member of the general public. I am a member of the media.
Please release these records.
Media members are members of the general public - furthermore, the media request documents for the sole purpose of informing members of the general public about the records. A court order is necessary to release any 9-1-1 call under Section 610.150 RSMo.
