Mr. Castrilli,

I appreciate the responses to my other requests, and the willingness of the various agencies who processed them to waive or reduce the charges associated with fulfilling them. However, I have now followed up 5 previous times on the request copied below that was sent on March 4th.

As you know, responses to Virginia Freedom of Information Act requests are required within 5 business days. It has now been 20 business days since I submitted this request. I did not receive a request for more time, but even if such a request had been made, the law requires that it be made within 5 business days, and only allows 7 additional working days, for a total of 12 days.

§ 2.2-3704 of the Virginia Code states:
4. It is not practically possible to provide the requested records or to determine whether they are available within the five-work-day period. Such response shall specify the conditions that make a response impossible. If the response is made within five working days, the public body shall have an additional seven work days in which to provide one of the four preceding responses.

C. Any public body may petition the appropriate court for additional time to respond to a request for records when the request is for an extraordinary volume of records or requires an extraordinarily lengthy search, and a response by the public body within the time required by this chapter will prevent the public body from meeting its operational responsibilities. Before proceeding with the petition, however, the public body shall make reasonable efforts to reach an agreement with the requester concerning the production of the records requested.

E. Failure to respond to a request for records shall be deemed a denial of the request and shall constitute a violation of this chapter."

I would prefer to make a good faith effort to resolve this request, rather than seeking redress in more formal avenues, so what reasonable arrangements can be made for this request? I am willing to extend more time (up to 30 calendar days) for processing this request if fees for fulfilling it will be waived.

Please let me know if this is an acceptable compromise. I would need to receive a response via email no later than 10:00 AM on Monday, April 6th.
