Hello,

Thanks for the clarification. Please proceed with the SWAT Team VFOIA request.

I would prefer to inspect the FOIA logs for FY2013, FY2014, and FY2015 in person. What is the cost associated with on-site inspection?

Thank you,
Yani Yancey

Yani Yancey,

Listed below are the County Attorney's responses to your follow up inquiries:

1. Does your estimate for the SWAT VFOIA requests for January 1, 2014 through March 2, 2015 include only the requests and their status, or also copying the records provided under these requests?

The 10 pages are only the request and the response, not the records provided with the response. You requested "VFOIA requests (and status of these requests) for Special Weapons and Tactics (SWAT) team use in Fairfax County submitted between January 1, 2014 and March 2, 2015." Thus, because you only requested the VFOIA requests and their status, which is shown on the response to the VFOIA requests, the 10 pages does not include the documents that were provided with the response.

2. Is it correct that VFOIA request logs for 2013-March 2, 2015 are only 30 pages, and VFOIA request logs for 2014-March 2, 2015 pertaining only to SWAT are 10 of those pages on their own?

No. You requested "FOIA logs for FY2013, FY2014, and FY2015 through the date this request is processed, including status of each received request." You later changed fiscal year to calendar year. The 30 pages responsive to this request are only the logs for calendar years 2013-2015, not the actual VFOIA request, the response, or the records that were provided in response to the VFOIA request.

If you want to proceed with these two FOIA requests, please let me know. I will email the responsive documents but if they are too large, I will have to send them to you on a DVD.

Mr. Cole,

Thank you for the SWAT FOIA records and for offering to set up an appointment to inspect the FOIA logs.

Would it also be possible to inspect the civil litigation logs requested under 15-FOIA-100 at the same appointment?

Thank you,

Yani Yancey,

We are still available for you to come to our office located in the Massey Building at 4100 Chain Bridge Road, Fairfax, Virginia 22030 to review the 2013-2015 FOIA logs which you asked to inspect. We also have a portion of the documentation which you requested regarding Sobriety and Safety Checkpoints available for your review. Mr. Cole,
Thank you for following up and offering a less costly option. Would it be possible to come see these next Friday, April 3rd at 10:00 AM?

Also, would it be possible to see use of force reports at that time, and the records on the David Masters case, or would I need to start a new FOIA request for that?

Thanks again for all of your help.

Yani Yancey,

We have an appointment set for this Friday. I have reviewed and redacted all personal information from the last 5 years of FOIA logs and have saved them to disk. I also have five years of motor carrier safety checkpoint data available for you on disk. Attached is a cost estimate for $103.99 for the production of this information. It actually took 3 hours to do the redactions of all personal information included in the five years of FOIA logs, but a decision was made to defer a portion of the cost. Please advise if you would be interested in receiving this information either by mail or you are still welcome to come in on Friday April 3, 2015.

Michael Cole

Thank you, Mr. Cole.

In that case, please cancel the appointment and mail me the documents. I prefer to have them in their original digital format(s) if possible. In other words, Excel spreadsheet, Word document, et cetera, rather than printed and scanned as a PDF.

Thank you,
Yani
