Any and all emails and attachments sent or received by School Board Member Elizabeth Schultz between January 1st, 2016 and date of request that contain the following keywords -
"Family Research Council”
“Transgender”
“Policy 1450”
“Liberty Council”
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This e-mail serves as a reply to your two Va. Freedom of Information Act (FOIA) requests received May 5, 2017, and duplicated May 12, 2017, for the records outlined below.
You requested "Any and all emails and attachments sent or received by School Board Member Elizabeth Schultz between January 1st, 2016 and date of request that contain the following keywords:
1. Family Research Council
2. Transgender
3. Policy 1450
4. Liberty Council"
Under the Code of Va. §2.2.-3704.(A), the Virginia Freedom of Information Act entitles citizens of the Commonwealth to inspect public records in the custody of a public body, its officers and employees. This code also requires us to verify your legal address. Your address is in Massachusetts, and on this basis, you do not qualify as a requester under the Act.
However, there were several VFOIA requests submitted in 2015-2016 from a foundation, Judicial Watch, which are similar to yours. Their requests were for all e-mail commination from all FCPS School Board members and various FCPS personnel regarding:
· Fairfax County Public Schools (FCPS) Policy 1450;
· Transgender students/staff;
· Gender equality;
· Same -sex marriage;
· Recruiting and hiring of a consultant to guide implementation of FCPS Policy 1450.
Since these records have been released and are readily available, there are no incurred search fees. Va. Code §2.2-3704(F) allows FCPS to make reasonable charges for the costs associated with supplying these records). If you wish to receive these records at no cost, please let us know.
