Pursuant to the Oregon Public Records Law, I hereby request the following records:

1. the total number of use of force incidents reported by law enforcement, separated by year and by type of force used from 2013-2020 (for example, "27 taser incidents in 2019, 3 baton incidents in 2020, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained from 2013-2020, separated by year (for example, 8 complaints in 2016, 2 complaints sustained in 2016, 4 complaints in 2017, 1 complaint sustained in 2017, etc.)
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2013-2020, separated by year.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2013-2020, separated by year.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2013-2020, separated by year.
6. all information reported to the FBI’s National Use-of-Force Data Collection program to date.
7. a list of all officer involved shootings that were directed at a person from 2013-20 (excluding shootings of animals and accidental discharges that are not directed at a person).
8. the total amount of money paid out in lawsuits and settlements relating to allegations of police misconduct per year from 2013-20. This includes copies of all reports, lists, databases, or individual documents that detail lawsuits brought against the city's police department and the outcome of lawsuits brought against the city's police department including any financial settlement occurring from 2013-20. It should also include any documents that your department submits to local, state, or federal agencies listing the number and/or status of lawsuits brought against the police department. This request includes any documents compiled quarterly, annually, or in other increments as well as any documents or databases that contain responsive information.

If only partial information is available responsive to one or more of these requests, please provide all of the information that is available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Samuel,

We are in receipt of your public records request today, July 21, 2021. In correspondence, please refer to PRR 3028, which is the number assigned it for tracking.

I have reviewed your request and this is a complex one that will require other departments and offices to respond: Police Auditor’s Office may be the keeper of some of the records, some of the records are already posted on the independent Police Auditor’s Office’s website. The City Attorney or other Central Services Office will have the lawsuit information. I am checking on the officer-involved shooting request as well. Please stand by for me to figure out where this will be routed and I will update you about that.

The portion for which EPD can respond will be about the FBI data and I have a clarifying question on this:
“6. all information reported to the FBI’s National Use-of-Force Data Collection program to date.”

Are you asking for all data since the beginning of the department or for a specific timeframe?

Thank you for responding. We have been sending crime data to the FBI for years. If it is specific to the use of force by officers, then we will check into the request as ‘all data related to use of force sent to the FBI since 2019.’ Would this be what you are seeking?

Greetings,

The City of Eugene acknowledges receipt of your Public Records Request. I am assisting with item eight (8) about claims from your request. Before we can proceed, the City needs clarification about the information you are requesting.

1. You are looking for the total amount paid per year paid out in lawsuits and settlements. Are you requesting the amount paid to claimants or for all costs associated with lawsuits and settlements such as legal costs and attorney fees? You do not need individual claim costs?
2. We can provide a report listing information which can include the claimant name, description of claim, dates, and settlement amounts. This would take around an hour to compile, depending on your answer in number one. However, your request asks for the documents involved with each claim and this would take several days to compile and therefore a much higher cost. How would you like to proceed?

Once I hear from you, we will be able to determine a cost associated with you request.

Hello,

On July 20, 2021, the City of Eugene received your Public Records Request. This response only addresses item #8 for: “the total amount of money paid out in lawsuits and settlements relating to allegations of police misconduct per year from 2013-20.” You clarified that a report providing “total costs associated with the lawsuits and settlements, in a report listing information such as the claimant name, description of claim, dates, and settlement amounts” would be responsive to your request.
City staff have determined that the City is in possession of records responsive to your request.

We estimate that it will take approximately 5 business days to process your request. We estimate that the cost of collection, review, and copying of the records you requested will be $41.31.

Once the City receives payment of $41.31 staff will begin processing your request. If the estimated cost exceeds the actual cost of responding to your request, the City will refund the difference. If the actual cost of processing your request exceeds the amount you have paid the City, you will be required to pay the difference before the City will provide the records you have requested. The City will not begin processing your request until you have paid $41.31.
