Pursuant to the New York Freedom of Information Law, I hereby request the following records:
1.) Any and all Erie County Sheriff's Office Voluntary Statements that are signed by Kevin Riford and dated 06/28/2019. Upon information and belief, the aforementioned record requested is one page in length.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

1.) I am appealing the constructive denial of my FOIL request, originally submitted on 04/04/2022
2.) On 04/04/2022 a FOIL request was submitted via email to john.greenan@erie.gov for "1.) Any and all Erie County Sheriff's Office Voluntary Statements that are signed by Kevin Riford and dated 06/28/2019. Upon information and belief, the aforementioned record requested is one page in length."
3.) On 04/28/2022 Ms. Mary May stated "Please be advised we are in possession of your FOIL Request pertaining to voluntary statements signed by Kevin Riford dated, 6/28/2019. Please note we will respond within 20 business days regarding documents responsive to your FOIL Request."
4.) As of today (6/14/22) , 33 business days have elapsed. The Erie County Sheriff's Office has failed to repond to follow ups to check the status for the records and has not provided the records in the given timeframe. These follow ups were sent on 5/31/2022 , 06/03/2022 , 06/07/2022, and 6/11/2022. For the following reasons, I hereby appeal the Erie County Sheriff's Office constructive denial of my request.

Dear Ms. Riford:
Initially you provided ECSO with a request to search for a statement made by your son, Kevin Riford, on 6/28/2019. A proper search based on the name and date, provided by you, was conducted. That search yielded no results, of which you were notified that ECSO did not possess any files RESPONSIVE TO YOUR REQUEST. ECSO only provides records that match the parameters provided by the requester, for the integrity of all involved parties.
Per your additional request, ECSO has undertaken a second search under the name Kevin Riford (no date) and the only record that came up was for CL 19-020931, which is for the date MARCH 15, 2019. We have attached the certification, as this is the only record that came up in ECSO's database that specifically includes the name of Kevin Riford.
Additionally, we regret that your requests are belatedly addressed. However, they are being faxed to an unidentified number that is not the ECSO FOIL or Administrative Office. Whomever is receiving these faxes may not be fully aware of the FOIL protocol and may not be forwarding them accordingly to the proper attention. For all future correspondence, kindly email your FOIL requests directly to linda.pawenski@erie.gov and we can assure you that your requests will be handled in a most timely manner.
